30 JUL 21: Status of ongoing review of transfer orders kept in abeyance since last two months: SNEA MH is continuously getting queries from members about over delayed review of the transfer orders kept in abeyance on 02/06/2021.

·        In this regards it is to inform that the review of these old orders has been started with restoration of Tenure station orders was issued on 26/06/2021 in first phase.

·        Since then second phase of review of transfers from Non-Tenure to Non-Tenure is going on and SNEA MH has repeatedly held meeting with CGMT MH, GM HR Admn Mumbai and CE Civil Mumbai who is till in charge of review of the orders kept in abeyance.

·        It has been assured to us by CGMT MH and CE Civil Mumbai that orders for filling shortage is certain SSAs and ERP relieving of Executives to and from Tenure stations will be issued in this week.

·        Though CGMT MH has expressed displeasure over the undue delay in restoration of orders, the things are not moving forward as directed and assured by CGMT MH.

·        Today is last day of this week by which CE Civil and CGMT MH have assured to at least issue second phase of transfer orders i.e. filling vacant post in shortage SSA and then ERP relieving of executives to and from Tenure stations.

·        We have seen that CE Civil and DGM Leal are working on it continuously and on many occasions matter has been discussed with CGMT MH, but till the final shape is not given and it has created much unrest among the executives. As seen in the past, the normally such orders are issued on Saturday, hopefully today being Saturday, the full stop will be given to ongoing discussions between these officers and matter will be firmly decided by CGMT MH and orders will be issued giving relief to executives who are kept in tension and pressure for last two months.

·       Otherwise, SNEA MH will again take up matter with CGMT MH for completing this review work by these officer either by removing these officers from other works for 2-3 days so that they can focus on this review work only or otherwise change the officers who are not able to complete this review for last two months and either CGMT MH should take this review or nominate other efficient officers who can complete this work in time bound manner and give relief to the executives who are facing hardship due to undue delay in restoration of the transfer orders kept in abeyance since last two months.

·       SNEA MH appeals all the affected comrades to keep some more patience and we fully agree with difficulties and hardship faced and expressed by the affected comrades, and assure that these manmade issues will be surely settled very shortly and its matter of just few days. Let us hope for the best.

 

30 JUL 21: DGM Admn BSNL CO writes to Circle/Unit Heads conveying detail about “BSNL Employees Health Insurance Policy 2021” which will be implemented w.e.f. 01/09/2021.  Letter <<<>>> 

·        Though this is matter related to employees, DGM Admn has failed to mark its copy to Unions and Associations which should have been given in routine and normal course of action.

·        This policy will be optional and its premium is to be paid by employees.

·        Willing employees will have to submit the options through ERP/ESS Login Portal after opening PoP UP Window and its dates will be announced separately.

·        The Insurance Cover of Rs Five Lakhs will be available to all employees with Top up value of Rs 5 Lakhs.

·        The Insurance Cover of Rs Ten Lakhs will be available to all employees in pay scale of E5 and above with optional Top up value of Rs 5 Lakhs and Rs Ten Lakhs.

·        There should not have been any restriction depending on pay scales and it also should have kept optional for all employees.

·        This Policy will be valid for one year and renewable thereafter with mutual consent between BSNL and Insurance Company.

·        The premium applicable will be different depending on Insurance Cover required and option given to included parents under this policy.

·        This would have been best policy if the premium of policy is paid by BSNL even by reducing / stopping benefits being given under BSNL MRS Scheme.  

·        It was also possible that the premium amount of this insurance is reimbursed from or adjusted with the annual limit of outdoor medical claims of employees and this would have saved lot of money of BSNL.

·        But it is unfortunate that nowadays it is seen that every burdon on part of management is systematically passed on to employees and in one sided action employees are compelled to pay the different premiums from their salary that to be without grant of Pay revision and continued Pay anomalies including Standard pay scales and related issues.

·        It is important that MTNL has recently come forward with Insurance scheme wherein premium is paid by MTNL.

·        When CMD and many of Directors of Boards are common to both PSUs, it is expected that BSNL Policy issued after MTNL policy should have similar methodologies including payment of premium, which is missing in this order.

·        Let us hope that BSNL management makes suitable changes in the policy and premium of this insurance policy is paid/adjusted by BSNL and employees are not compelled for its payment from salary. 

 

30 JUL 21: AD Staff A Mumbai published the stay particulars of JEs working in different SSAs of Maharashtra Circle. Letter <<<>>> 

·        This is as per the request made by SNEA MH to CGMT MH and CE Civil Mumbai who is looking after review of the transfers orders kept in abeyance since last two months.

·        Nowadays JE, JTOs and SDEs are counted together in long stay list for transfers, but among JEs there is different in recruitment due to changes in Recruitment Rules. Some JEs are recruited in SSA Cadre and some are recruited in Circle Cadre.

·        The JE recruited in SSA Cadre cannot be transferred to other SSA except he/she request under Rule 8/9 but JEs recruited in Circle Cadre can be transferred from one SSA to another SSA as that of JTOs/SDEs.

·        While counting in long stay, the JEs of SSA cadre were also shown but were not transferred and hence there was confusion among the other JEs and JTOs/SDEs about their correct position in long stay list.

·        Now it is clear who is JE of SSA Cadre and who is from Circle cadre and accordingly one can analyze his/her correct position in combined long stay list of JEs/JTOs and SDEs and decide on giving not giving options/request for transfers.

Some of these SDEs were under transfer within Maharashtra Circle, but were not relieved and their order within MH Circle is also cancelled and they will be directly relieved to J&K Circle. 30 JUL 21: AGM Pers BSNL CO issued second corrigendum to the JTO to SDE Promotions wherein the working Circle wrongly mentioned in the JTO to SDE Promotions orders issued recently were shown wrong and now same are corrected for 92 SDEs.  Letter <<<>>> 

·        Earlier just before week names of 80 executives were deleted from promotion orders due to different reasons and now circles of 92 SDEs are changed.

·        As this order was issued in unnecessary hurry and without going to much details of correctness of data during specific period when window for membership change was open just to bring more decision among executives among different association many more corrigendum are expected in days to come. 

 

30 JUL 21: DGM HR Mumbai endorsed BSNL CO letter for conducting  post Audit of Pay fixations done in Circles/Units on account of promotion, upgradation and pay revision by Finance wing officer of the rank of AGM/CAO  and above who is not connected with the channel of submission of the pay fixation related works. 30 JUL 21: AGM MMT BSNL CO issued orders for uploading the experience certificates issued to contractors with relevant details on link given for same on BSNL Intranet Portal. Letter <<<>>> 

Letter further states that while issuing experience certificate intrinsic details of contractors i.e. PAN, GSTN, Address of Works/ Registered office,   specific details of work done, period in which work executed and performance of contractor are invariably incorporated.

26 JUL 21: Meeting with Shri. Aman Jaiswal, CE Civil Mumbai and Ex GM HR Admn Mumbai: On 24/07/2021, SNEA delegation consisting Shri. M. N. Kotambe, ACS SNEA MH, Shri. Abhay Kesarkar, JS CE SNEA MH and Shri. M. S. Adasul, CS SNEA MH had meeting with Shri.  Aman Jaiswal, CE Civil Mumbai and Ex GM HR Admn Mumbai to discuss different pending HR issues and also issues related to Civil wing. The detail of discussions is as follows.

1.     Request transfers of Executives in Civil Wing: We have requested for consideration of request transfers of executives in Civil wing. CE Civil Mumbai informed that he is on the job and is giving final shape. He informed that there is acute shortage of executives in Civil Wing Maharashtra and along with requests he will be issuing some transfers to fill vacant posts by keeping at least one SDE/JTO Civil in each SSA. He added that when he is having acute shortage, the transfers are being issued out of Maharashtra and he has to again think on rearrangements. He cleared that he is giving final shape to rearrangements and transfer orders of Civil wing JTOs and SDEs giving consideration to maximum requests as well as for filling vacant posts will be issued very shorty.

2.     Restructuring of Civil wing Executives and its impact on rearrangements proposed:  We have drawn attention of CE Civil on the revised and latest restructuring norms proposed by BSNL CO. As per this justification, there is need of more executives of Civil wing in Maharashtra Circle and accordingly there is more need of executives in different BAs and SSAs. He agreed to concern expressed by him and there is need of more executives of Civil wing in many of BAs/SSAs, finally it is subject to availability of executives. Though justification will be more for all cadres of Civil wing, the availability of total number of executives of that cadre even by considering look after arrangements is important. He assured that if some more number of executives are posted to MH Circle, the posting as per norms will be taken care, but at present it is not possible and he has to manage show among available executives and hence some transfers under rearrangements are must.   We requested to keep it minimum and he responded he has kept it minimum and at least one Executives for each SSA in case of shortage is the proposal he is making and final decision on it will be taken by CGMT MH circle.

3.     Status of transfers to Fill Vacant posts in SSAs having shortage of executives: We have informed him that we had meeting with GM HR Admn Mumbai for knowing status of review of transfers, but he has informed that he is not having any update on it and directed us to discuss this issue with us. CE Civil Mumbai responded that it is known fact that as per instructions of CGMT MH, the review of transfer orders kept in abeyance and its restoration is being done by him and he is on job. He updated that he has scrutinized all the options received and also decided list of longest executives from SSAs who are now due for transfers to SSAs having shortage of executives. No matter is being reviewed for consideration of requests of longest stayed executives who are having wards studying 12th Standard, having immunity from Transfer and also have requested for retention on rounds of critical illness. He added that it is matter of day or two and he was supposed to complete it by end of this week but DG legal is on leave. He informed that CGM Sir also is reminding him for early restoration of all Transfers and hence is has to complete this work early in this week.

4.     Additional options for filling vacant posts and actual dislocation of executives: When we asked about probable dislocations of executives, he added that total figure is much reduced in this review process and many have opted for the nearby or suitable SSAs and hence his work of rearrangements has been reduced. But Shri. Jaiswal CE Civil Mumbai added that after giving consideration to all options at own cost till there is requirement of executives at following SSAs as many of executives have not yet given option or if given any option, it is for SSAs already having excess executives and this cannot be given consideration as they are due for transfers from excess to shortage SSAs on basis of their long stay.  He specifically shared with us that till there is requirement of total 38 executives. He also shared SSA wise break up of requirement in different SSAs i.e.  Beed: 07, Buldhana: 04, Nanded: 03, Parbhani: 06, Satara: 03, Solapur: 08, Osmanabad: 06, CNTXW at Akola: 01, CNTXW at Pandharpur: 01.  He mentioned for these many vacant posts, no options are received and hence 38 executives from the SSAs having excess executives will be transferred and posted randomly with preference to nearby SSAs. He also shared the SSA wise break of total 38 executives to be transferred in this phase viz. Amravati: 02, Bhandara: 08, Kalyan: 05, Nagpur: 12, Nashik: 06, Pune: 05. We have narrated that there are chances of getting some more options and asked him about its consideration. He added that matter is already delayed and CGMT MH has directed to complete it at the earliest and asked us to submit additional options if any. We informed that we have shared entire list of options to these SSAs to GM HR Admn Mumbai including list of request for excluding names from transfers on educational grounds, immunity and medical grounds. We also added that we will again have review of options submitted and left out among longest stayed executives from SSAs having shortage of executives through our DS and if any fresh option are given, same will be shared on Monday. We also informed that we will give wide publicity of left out vacant post among executives due for transfers and if anyone is ready to give option, we will ask them to send it AD Staff A Mumbai by email or what’s app or we will share it by hand. Shri. Jaiswal CEC Mumbai informed that it will be supportive to him but he cannot give more time and options if any as fresh may be given by individuals latest by Monday and assured to give consideration to all such options received.  In conclusion of discussions on this point he firmly assured that as majority of work of review is over, he has decided to finish remaining works by this week itself but he could not finalize it as DGM legal is on leave but assured that it will be completed by mid of next week and restoration orders for filling vacant post of in Shortage SSAs with required changes will be issued accordingly.  

5.     Posting to SSAs having less vacant post but more options:  We have discussed issues about SSAs having less vacant post and more options and specifically about posting to Circle Office, Mumbai. CE Civil Mumbai informed that in such cases the request from the executives with highest stay will be given consideration to the extent of vacant posts. In case of Circle Office only three posts are vacant and two JTOs on deputation having joined Circle Office and hence net vacancies at Circle Office has reduced. As such, though more than 25 options are available for Circle Office, only few or may be nil options for Circle Office will be given consideration. The executives in long stay will be posted to other SSAs having vacant post due to shortage. The request of other executives to Circle Office who are not in long stay list of SSAs having excess executives and executives from other SSAs will be given consideration in one to one request transfers in next phase.   

6.     ERP relieving of executives from tenure stations: We conveyed thanks for restoration of Tenure station orders in tune with the transfer policy guidelines. We also conveyed that SSAs like Sindhudurg, Goa, Gadchiroli have relieved certain executives but till many are not relieved. The executives who have completed tenure and not yet relieved are facing hardship due to delay in relieving and they are worried as their relievers are not relieved and there is uncertainty on their joining and hence there is unrest.   Further the date given for ERP relieving is already over and in last meeting CGMT MH has given target date of this week end for their relieving, but same is not being followed. Shri. Aman Jaiswal CE Civil Mumbai informed that there is issue as the executives who are yet to be relived are from SSAs which has already acute shortage. The SSAs like Solapur have relieved some executives and asked time for relieving of remaining executives as they are facing problems for handing over charge as reliever. As such it was decided by CGMT MH that first orders for filling vacant posts will be issued and later as immediate steps the process for ERP receiving of all left out executives including executives from tenure station will be taken care. We requested for early action on it and He assured for issuing orders for ERP relieving by end of coming week. 

7.     Restoration of request transfers from Non-Tenure to Non-Tenure SSAs: We have drawn attention of CE Civil towards the fact that since request transfers are kept in abeyance, the period of more than one and half month is passed and there is no sign of immediate restoration of request transfers. Some of them are relieved by their SSAs and have joined in transferred SSAs, but in majority of SSAs the executives who were under transfer as per their requests are not relieved. Some of them have shifted family as per order issued and are facing hardship as orders kept in abeyance are not restored. Shri. Jaiswal CE Civil Mumbai informed that he agrees that there is delay but by considering issues in review of orders for filling vacant posts from calling for options and its analysis, more time has been taken in this orders. But for request transfers the policy is for one to one posting and it will not take time more than weeks. Also majority of requests are already issued and it will be matter of just posting substitute from SSA to which request is pending. He assured that in coming week the Excess to Shortage orders and ERP relieving of Executives left out in tenure orders will be completed and by next week the request transfers from Non-tenure stations will also be restored.

8.     Publication of revised long stay list of JEs: We have informed that though it was assured in the meeting held with CGMT MH to publish long stay list of JEs by excluding names of JEs who cannot be transferred out of SSAs being SSA Cadre. CE Civil Mumbai informed that he has already directed DGM Legal Mumbai to publish list of JEs as discussed. He added that today he is one leave and Monday he will direct him to publish the SSA wise long stay list of JEs. But he added that there is no much impact on overall process and very few number of JEs are not eligible for transfer out of SSA and majority can be transferred out of SSAs. But he assured that as discussed the list of long stay of JEs will be published on coming Monday. 

9.     Confirmation of Excess shortage strength of SSAs on basis of actual working of executives: We have drawn attention of CE Civil Mumbai towards the difference in actual working figures of executives and figures shown working by staffs section. We requested that association has already shared the details of Nashik and Kalyan SSA and how there is difference. Shri. Jaiswal CE Civil Mumbai informed that he has   checked the figures and has shared all details with us. In Nashik SSA, there are total 105 Executives i.e.  08 DEs, 36 SDEs, 42 JTOs and 19 JEs and Two DE from Circle Tenure stations will be joining Nashik and two DEs from Nashik will be shifted out of Nashik. Two JTOs are under tenure transfers. Total justified at Nashik SSA are 94 (92 SSA+ 02 Mob). Thus out of 105 working executives 94 are justified and hence 11 are due for transfers. We have narrated that as per calculations given by DS Nashik, the total working figure is about 98 and not 105. We assured to confirm the figures again and Talley it with the figures given. Same is case with Kalyan SSA, as per figures given by CE Civil total 76 Executives are working in Kalyan SSA and its break up is DGM : 00, DE : 00, SDE 22, JTO 34 (33 SSA+ 01 Mob) and JEs 20.  Further as per orders pending DE: 02, SDE: 01, and JEs:  02 will be joining Kalyan SSA as per orders pending from tenure station. Thus total strength of Kalyan SSA with transfers pending goes to 81 and thus there are five excess executives. After understanding figures of additional posting from tenure stations, we have also seen that there is no difference. But as the detailed list of JTOs was not available with us for confirmation, we have assured to discuss the details shared by CE Civil Mumbai and get its confirmation from DS concerned.  CE Civil Mumbai informed that he has readily available data of executives and hence he is firm about the excess shortage shown. We have asked for exclusion of names of executives who are absconding, under transfer to other Circles and due for rule 8 transfers. He informed that all such names are excluded and these are figures after excluding these names. We assured to get the details shared by him confirmed with actual working figures from DS concerned and if these figures are matching we do not have any issue in it.  

10.            Review of Requests transfers of Account wing: We have requested CE Civil Mumbai to have review of the Transfer orders of Account wing Officer and many have submitted revised request and rearrangement is quite possible. CE Civil responded that the tem f staff section is focused on the excess to shortage and tenure station orders of Telecom wing executives and hence till review of Account wing transfers is not completed though many of the request are received. He assured that very shortly this review also will be completed including request transfers and transfers from SSAs having excess executives to SSAs having shortage of executives. He assured to complete review of account wing immediately after completion of Telecom wing transfers and maximum within fortnights period. 

11.            Issues created due to Deputation of JTOs from Electrical wing to Telecom wing: We have drawn attention of CE Civil Mumbai towards the critical issues faced by some Electrical wing JTOs on deputation to Telecom wing. Though these executives are relieved by Electrical wing, they are not allowed to join by some of SSAs and if allowed to join, then no work allotted to these JTOs. We have shared copies of letters written by some of SSA Heads with reason why they are not willing to give works to these JTOs. Shri. Jaiswal CE Civil Mumbai informed that he has seen such letter and agreed that there is need of review of orders of JTOs which are issued to SSAs already having excess executives. He conveyed that these orders will reviewed and he has already directed DGM legal to take care of it and firmly assured to resolve it shortly.  

12.            Consideration of Request of JTOs in Electrical wing: We inquired with CE Civil Mumbai about the status of request transfers in Electrical wing. He informed that same will be taken care by Electrical wing but CGMT MH has directed that all works related to transfer posting is to be centralized with GM HR Admn Mumbai. This time it will be take care by Electrical wing through GM HR Admn Mumbai. We have narrated two requests of JTO Electricals at Bhandara and Dhule, who have served for more number of years in these SSAs and were waiting for their request transfers, but instead of it, they are transferred to Telecom wing in same SSA. They are facing issues while working in Telecom wing and also they are in need of transfers as they have served for more period more than three years in these SSAs. In response Shri, Jaiswal CE Civil Mumbai assured to look into such cases after discussions with GM HR Admn Mumbai and CE Electrical Mumbai as these are old cases. 

13.            Dispute between Account wing and HR section: We have reminded him our discussions in the meeting with CGMT MH and requested him about resolution of the ongoing dispute among Account and Telecom wing and clear pending works like confirmation of JAOs and some individual cases pending for long time viz. case of final approval of resignation of Shri. Altab Malik then JAO Mumbai who has resigned BSNL before one and half year, but till formal and final approval is not issued due to this dispute. CE Civil Mumbai informed that there was dispute as the files were not officially handed over to HR section from then FC section and after discussions in meeting with CGMT MH he has directed DGM legal to get the issue settled. He assured that all pending cases held up due to this dispute will be settled shortly and directed us to remind in Monday so that same can be taken care.

14.            Delay in releasing salary of AO working on deputation and no action on part of DGM legal Mumbai: We have narrated case of Shri. Pankaj Marathe, AO who is deputed from Dhule to Pune by Account wing for special activities and his salary is not withdrawn as his ERP in transferred to Chandrapur as per HR section order and he is working at Pune as per account wing order. The file has been sent to DGM legal since last two months and as per his say the deputation order is not issued in consultation with his office and hence he will not take action about it. Due to this Shri. Pankaj Marathe AO is working without Salary at Pune SSA for last three months and facing hardships and issues. Shri. Jaiswal CE Civil informed that he is aware of case of Shri. Marathe and has already instructed DGM legal to settle the issue and if not yet settled , he will see that it is settled in coming week after joining back of DGM legal from leave.

15.            Pending no dues certificates of Retired Executives: We have drawn attention of CE Civil Mumbai that there are some cases wherein no dues certificate is issued by Estate section Mumbai and there is undue delay in issuing certificate. Earlier we have brought these issues to the notice of DGM Admn Mumbai and even though he has assured for same, no final action was taken by JTO Estate and good amount is deducted from the dues of retired executives and then individual have to run from pillar to post for getting refund of deducted amount. Now also 3-4 cases are pending and needs no due certificate issued before end of this month otherwise, deduction will be implemented and we specifically narrated case of Mrs. Jerine AO Mumbai VRS Optee. CE Civil assured that matter will be taken care so that no one suffers from undue deductions. 

16.            Issues related to Fake caste complaints: We have drawn attention of CE Civil about the issues faced by the executives against whom the complaints of fake caste are received and MH Circle has started action against these executives and non-executives. CE Civil informed that actually he want to discuss this issue and it is better that SNEA has raised this issue. He made it clear that his name is being propagated by some units/individuals as he is against these employees who are facing complaint of fake caste, but fact is that he was never against anybody and there is no reason for him to act against anybody. He shared some incident about discussions and sms from GS SNPWA Shri. Jogi and his discussions thereof o issues related Fake cate complaints and said pendency on part of BSNL Maharashtra Circle. CE Civil Mumbai informed that from his side matter is open to all and anyone can check the documents issued and correspondence made by Maharashtra Circle over the period. He clarified that Maharashtra Circle do not have any separate powers to deal with these cases and it is working as per directives from BSNL Corporate Office and caste validity law applicable in Maharashtra State. We have informed him that validity law will be applicable since date it has been introduced and it will not be applicable to any cases prior to it. He informed that he fully agrees with the concern and it should be applicable from date on which law came into force. But he added that in one of letter issued by then Director HR in year 2017, the directions have been issued for taking actions accordingly against Fake caste complaints and hence MH Circle is following these instructions. We have narrated that Maharashtra Circle should have taken up matter according to the existence of law and same should have been brought to the notice of BSNL Corporate Office. He informed that all the issues are repeatedly brought to the notice of BSNL Corporate Office, but for whatever may be reason, the matter is not clarified either by BSNL Corporate Office nor it is suitably taken with DoPT. We narrated that due to this many executives only from MH Circle are sufferers and all the issues in other circles including WTR/WTP within Territory of Maharashtra Circle are settled. He informed that the leave encashment issues were settled by WTR/WTP on priority and now same has been decided by MH Circle also as per recent guidelines issued by BSNL Corporate Office. We have narrated that recent guidelines have not given any relief rather there is addition of condition of indemnity bond which was not applicable earlier.  He agreed to our say, but asked to take up matter with BSNL CO so that fresh guidelines are issued and assured that same will be followed by MH Circle. We discussed about the cases wherein caste certificate is confirmed to be issued by the Issuing authority and strongly pleaded that at least in such cases there is no fault of individuals and they should be given relief. There are certain changes in administrative matters of Maharashtra State and even though certificates for some castes were issued earlier, same has been stopped at later stage or it is limited to certain districts and in such case validity at this stage is not possible as being asked by BSNL. We have narrated that executives who have rendered services of more than 25-30 years and opted for VRS are specifically under trouble as their pensionary benefits including provisional pension has been kept on hold even though Vigilance clearance has been issued and no case was pending with them on date of VRS. We also narrated that in many cases provisional pension as kept on hold for last one year and no action has been taken on it. CE Civil informed that Provisional Pension cannot be kept on hold, but CCA Mumbai has kept on hold some of the provisional pension and after repeated requests no list of such cases is given. He informed that till matter is not brought to notice of his office and list is given, his office cannot take action on it. We have informed that we have reported case of Shri. Tilwar and others since last January to Shri. Kadam JTO Recruitment Mumbai but he was adamant and has deliberately not taken any action in this case as if he is final authority. After his adamant stand matter was reported to DGM Admn Mumbai who was kind enough to firmly assure us to settle case of provisional pension of Shri. Tilwar SDE VRS Nagpur within months period and similar other cases, but even after seven months have passed no action has been taken and Shri. Tilwar and many others are suffering without even provisional pension. CE Civil agreed to concern expressed by us and   directed us to take matter with CCA Mumbai and get list of such executives/non-executives who are not getting provisional pension and assured to take immediate action on it within no time. He also narrated that one such request letter is being written to CCA Mumbai.  We have further narrated the issues faced by executives who are working and issued charge sheet for no mistake on their part. He added that this is being done as per directions of BSNL CO and if no action is taken by Maharashtra Circle, it has been directed to take action against such officers and hence action has been initiated and few charge sheets are issued and remaining are being issued will be served shortly.  Many of the affected executives have met him personally and were requesting for guidance and help but nothing in his hand and matter needs to be decided by BSNL Corporate office and if required matter needs to be taken suitably with DoPT for clear guidelines on applicability of caste validity to cases before Caste Validity law was implemented by Maharashtra State. We added that if clarification is issued by Maharashtra State that the caste validity is not applicable for recruitments made before validity of rule will it help these executives? He informed that he has guided certain officer exactly to get it issued and this will solve problem of many executives. We added that as per guidelines the caste validity is to be done within two years of recruitments and same has been done by BSNL/DoT in about all cases. CE Civil agreed to our say and informed that as per guidelines issued by the Director HR in 2017, the caste validity is made applicable for all cases for which fake caste complaint is received and hence there are issues. He finally directed us to take up matter with BSNL Corporate Office and /or State Government of Maharashtra and whatever documents/correspondence made by MH Circle can be made available, but no one should be under wrong impression that BSNL MH Circle is deliberately is against them and deliberately troubling these executives. This case has two sides as affected and complainants and both the sides are pleading their stand regularly and strongly and hence matter needs to be decided either by competent authority i.e. BSNL Corporate Office or by State Government of Maharashtra and whatever guidelines will be issued by them, will be binding to BSNL Maharashtra Circle to follow and assured for resolution of issues accordingly.  

17.            Immediate action for critical Maintenance of Staff Quarters in Mumbai: We have drawn attention of CE Civil Mumbai on the critical issues created due to poor or non-maintenance of BSNL Staff Quarters in Mumbai. We have narrated the critical condition of Buildings and how it is life threat for employee and their family members residing in these Staff quarters. We have added that we have received/taken some of videos and photographs clearing worst condition of Staff quarters wherein there are issues of structural damages of some of buildings. We have narrated that slap of terrace has fallen on lifts and lifts has been closed in high rise building and extreme hard conditions are being faced by residents. We also added that this shabby condition of building is reason for delay on part of other PSUs who have submitted proposal for taking on rent vacant BSNL staff quarters. The team of HPCL visited recently and have expressed issues about the shabby condition of BSNL staff quarter at Dadar and same is case with Wadala. The condition of staff quarters at Borivali, Santacruz, Andheri, Powai and Bhayculla is also not good and there are certain issues of maintenance which needs immediate attention.  Shri. Jaiswal CE Civil Mumbai agreed to the serious concern expressed by SNEA and the critical condition of BSNL Staff quarters is really worsening as no even minimum required maintenance is being done. He added that BSNL is getting good revenue under CROP Policy and same could not be done for want of funds.  He informed that this matter is already brought to notice of CGMT MH Circle and he also has directed him to take immediate action for maintenance of all Staff quarters in Mumbai. Accordingly, his office has prepared estimates of regular maintenance of Santacruz Colony and BSNL Admn Building of Santacruz and same are already approved. The similar action is being taken for all other Staff quarters is being started and during the process issues of funds is raised by Finance Mumbai and process is moving further slowly. He added that in regular maintenance works like Drain line works / minor water leakage arresting /Taps or Doors carpenter works are taken care. But for major civil works like structural repairing including major wall /beam cracks /major water leakage from ceiling /walls like lift rooms slab plaster collapsed etc comes under capital works/special major repairing works. For these capital works special Project related WBS /budgeting funds is required and request for same is being sent to BSNL Corporate Office. He further added that he has received photos and videos of maintenance and structural issues of Dadar and Wadalba colony about recently happened incidence and accordingly  SE Civil and EE Civil visited sites and work of preparations of estimates as per their observations is under process. As per meeting with GM Finance for Civil and Electrical maintenance presently common funds are available under different heads /nodes like Building Repairs & Maintenance, Building works and under this some funds are booked but expenditure has not been carried out and there is need of review of the booked funds but not utilized. His office is reviewing this issue in consultation with finance wing and special funds request will be sent to BSNL Corporate Office and special approval thereof. For Mumbai area itself at least Rs Five crores are required for such urgently needed structural repairing works. He added that as per the estimates only for minimum required maintenance of all colonies immediately Rs One Crores are required and for structural repairs and other major works more funds will be required. He added that CGMT MH has assured to take up matter with BSNL CO for availability of funds. He also added that matter is also discussed with HPCL for providing funds for repairs as advance deposit and same can be adjusted against the rents. CE Civil further added that he is in touch with GM Finance Mumbai and he also has assured to take up matter with BSNL CO for funds for repairs works of the BSNL Staff quarters all over Mumbai. CE Civil Mumbai firmly assured that he is very keen on such issues and action will be taken as per availability of funds and works will be taken care on priority. He directed us that association also should to take up matter with BSNL CO for allotments of funds so that issues can be taken care at the earliest.

18.            Delay in allotment of Staff quarters in Mumbai: We have narrated that there are some request pending for allotment of staff quarters and more time is taken in processing applications by SDE Estate and the executives in need of transfers are facing issues. Shri Jaiswal CE Civil Mumbai informed that this work has been transferred to him but no AGM is transferred and only SDE alone with staff is transferred. He added that there is huge work in Estate section and it is difficult to manage the works with single SDE. He added that he has already discussed with CGMT MH for giving one additional JTO/SDE for same and he has assured to post one ore hand so that all such issues can be taken care. He informed that there is good revenue being generated from the rented Staff quarters under CROP policy and there is need of one more hand for taking all issues including accounting of rent payable and paid by Retired persons. He informed that there is delay in processing requests, but assured that steps will be taken for making the process of allotment of staff quarters fast. He also asked us to remind such pending issues fresh in next week and we assured for same

We have very fruitful discussions for more than one and half hour with Shri. Aman Jaiswal, CE Civil Mumbai and Ex GM HR Admn Mumbai and we have shared details feedback to him and he also has shared the relevant information even on cases by cases with progress of pending HR issues as per directives of CGMT MH Circle. In conclusion of meeting we have conveyed him sincere thanks for to depth discussion on all issues and assured to give additional feedback as per discussions and he assured to take care of all issues brought to his notice in time and directed us to remind specific pending cases in next week.

·        As these promotion orders were issued in hurry and mainly in late night to early morning there are such mistakes and corrective action has been started now.

·        Due to this, hundreds of JTOs are deprived from their promotion and it is reason for mass unrest among JTOs of recruitment year 2008.

·       Hopefully these vacant posts will be filed up by giving SDE promotions to next seniors in JTO to SDE seniority list.

 

18 JUL 21: DGM Legal Mumbai published data of options/willingness received by Staff section Circle Office Mumbai in response to options called from executives of Telecom and Account wing having excess executives to fill up the vacant post in SSAs having shortage of executives in Telecom and Account.  Letter <<<>>> 

·        SNEA MH has requested to publish this data of options received with GM HR Admn Mumbai and CGMT MH and accordingly this data is published.

·        In the start of this letter it is clearly mentioned that these are options received in reference of letter dated 02/07/2021 which is clearly mentioned under reference.

·        Accordingly, this data should have been limited to the options received for vacant posts in SSAs having shortage of executives and not entire data received after 02/0/2021 as done here.

·        It is crystal clear that either the own office letter is not clearly understood by DGM Legal Mumbai , or this is one more attempt to create confusion and unrest among the executives as in this data options given to SSAs having excess executives are also included.

·        Disclosure of such partial options have created confusion and unrest among executives whose request transfer are already given consideration and orders are also issued but kept in abeyance on 02/06/2021 for review as per transfer policy guidelines.

·        It is but natural that there are chances of missing any individuals request in such huge work and hence to have corrective action, we have requested to publish the data of options received so that one can understand where his/her option has been reached in Staff section Circle Office or not and if reached where same is taken into consolidated list being considered for giving choice posting or not.

·        SNEA MH has requested for publishing SSA wise long stay list of all executives including JEs, but after elaborate discussions, it was finally decided that only long stay data of JEs will be published as there are two categories of JEs and only JE recruited in Circle Cadre can be considered for out of SSA transfers on long stay basis and JE recruited in SSA Cadre cannot be transferred out of SSA on basis of long stay.

·        CGMT MH has firmly assured for publication of long stay data of JEs and directed GM HR Admn Mumbai for same, but same it not yet published and hopefully it will be published on Monday.  

·        Certain Officers in the Staff section were never interested to publish data of options received and may be with such negative attitude and reluctance data is published with casual approach which has created more confusion and unrest among concerned executives as immediately on publication of data, DS and COBs of SNEA MH have received many queries about it.

·        Only plus point in this published data is that this time different background colors are given to certain options, but nothing has been mentioned about colures in this letter, creating more confusions.

·        As per letters, discussions with CGMT MH and GM HR Admn Mumbai time to time on this subject, it was supposed to publish data of options only to SSAs wherein executives are shown as “IN” in the letter dated 02/07/2021. Copy  <<<>>>  

·        It has been firmly decided as policy matter that executives in Circle Long stay posted to tenure stations will be given option only for change of SSA within Tenure stations but not to any other non-tenure stations, but such options are also published in this list that to be SSAs having excess executives, which is totally wrong and misleading.

·        Executives and JEs who have given more than one option, any of the options may be given consideration as per availability of posts and options received thereof and if one has given option for more than one place, he/she should be ready for posting at any of the SSA for which he/she has opted.

·        It can be seen that Ahmednagar is having five vacancies of JE/JTO/SDEs and total five options are received for Ahmednagar SSA and request of all these executives will be given consideration.

·        But for Beed SSA where 10 post of  JE/JTO/SDEs  has not received even single option and hence the executives from SSA having excess executives i.e. SSAs against which executives are shown excess/Out  will be posted to SSAs like Beed where no options are received or option are received less than the vacant post.

·        For Satara SSA there are 10 post JE/JTO/SDEs vacant , but only nine options are  received including second, third and fourth option and all who have opted for Satara will be posted to Satara and one more executives from nearby SSA will be posted to Satara SSA.  

·        In Akola SSA two post of JE/JTO/SDEs are vacant but options received are four and hence only two options will be given consideration.

·        In Jalna SSA only four post are vacant and total nine JE/JTO/SDEs have opted for Jalna SSA and here requests of only four JE/JTO/SDEs from nearby SSAs will be given consideration.

·        In Amravati SSA there is no vacancy but seven executives have submitted options for Amaravati SSA/Mobile and hence there is no chance of posting any executive in this order for transfer of executives from Excess SSA to Shortage SSA. Same is case with Gadchiroli, Pune, Bhandara, Nagpur etc SSAs.

·        For Circle Office Mumbai there is shortage of three JE/JTO/SDEs wherein two JTOs have already joined resulting only one vacancy in Circle Office Mumbai, but total 29 options including third and fourth options are received for Circle Office Mumbai out of which only one will be given consideration in this orders. The chances of posting of executives who have given option to Circle Office is about ‘Nil’. But if they are not in long stay list their request will be given consideration to Circle Office Mumbai.  In this case, same number of JE/JTO/SDEs from Circle Office Mumbai will be transferred to the SSAs from where the request are shown towards the Circle office Mumbai. Same is case with Nashik, Pune, Amaravati Aurangabad, 

·        But if these executives are not transferred in long stay list to SSAs having shortage then at later stage their request may be given consideration on one to one basis as substitute.     

·        We have already discussed the matter for posting of executives who have requested at own cost request transfers from Shortage to shortage  SSAs  and same will be given consideration in these orders and excess executives  from excess SSA will be posted to these SSAs.

·         Accordingly all executives who are coming under zone of long stay transfers may have their own analysis of the shortage/excess of executives for which they have opted, their working SSA and his /her position in long stay list and go ahead with options given by them.

·        It may be please noted that requests/options with own cost for SSAs having options more than the vacant posts will be given priority over the company cost request/option.

·        Though it not mentioned in this letter, the executives who have opted or whose options are wrongly noted in this list are requested to represent their grievances by signed copy representation addressed to GM HR Admn Mumbai and send it by email on adstaffamhco@gmail.com for JE/JTO/SDEs cadres and adstaffbmhco@gmail.com for AGM/DGM cadres and its copy at agmstaffmh2018@gmail.com for all cadres from  JE  to DGM.  This exercise many be completed within day or two as the review to fill vacant post in SSAs having shortage is at final stage and orders will be surely issued in this week itself.

·        The executives from SSAs having excess executives who have once completed Circle tenure and now opted for not posting to tenure station second time , will be under zone of transfers to non-tenure SSAs and hence they will have to opt accordingly or be ready for posting at any of the place.

·        The executives who are in long stay and having children studying in 12th Standard in year 2021-22, will get retention for period of one year and if they apply before transfer orders are issued, their names will be excluded and hardship faced after issuing orders will be saved.   

·        Others who are in long stay of SSAs having excess executives and not yet opted for any SSA and their name is coming under zone of transfer as per excess executives or as per incoming request to their SSAs/Units may also have analysis of vacancy positions and incoming requests to their SSAs/Units and decide about submitting options or be ready for company cost transfer at any SSA/Unit having vacant post in this phase of review of transfers to fill vacant post at shortage SSAs or in next phase of review of request transfers which are kept in abeyance. 

·        Till any of SNEA member has any issue, he /she may contact DS SNEA concerned and/or to any of the COBs of SNEA for clarification required on any point of transfer policy guidelines and act accordingly in time to avoid any transfer at non-suitable or odd place.

 

18 JUL 21: AD Staff A Mumbai published data of options/willingness received by Staff section Circle Office Mumbai in response to options called from executives of Account wing having excess executives to fill up the vacant post in SSAs having shortage of executives in Telecom and Account.  Letter <<<>>> 

·        As per persuasion by SNEA MH with GM HR Admn Mumbai and CGMT MH and as rightly quoted in first para of this letter, the options of only JAOs/AOs from excess executives to SSA Having shortage of executives should have been published.

·        These options were called only for filling vacant post JAOs/AOs in specific BAs like CO Mumbai, Pune, Nanded, Chandrapur, Satara and Kolhapur BAs and one or two vacancies in other BAs.  Copy  <<<>>>  

·        But it is seen that all the options received by Staff section after 02/07/2021  are added in it and this list seems to be prepared so casually that in many cases options from same SSA to same SSA are mentioned without any reason thereof in remark column.

·        Request for other Circles including Rule 8 and Rule 9 requests are also added in this list. Apart from this refusal of DGM LA, request to SSAs already having excess JAOs/AOs is also added in the list.

·        When it is proposed to shift 40 JAOs/AOs from SSAs having excess JAOs/AOs due to centralized works at BAs (Except Beed SSA) having shortage practically only 20-22 options are received and out of that many are to SSAs having already excess executives.

·        There are more vacancies in Circle Office Mumbai, Pune, Nanded, Satara and Kolhapur BAs and except Kolhapur no other BAs have received sufficient options.

·       Till any of JAO/AO from SSAs having excess executives or having incoming request transfers may have analysis of the shortage /excess of decide on submitting options accordingly or be ready for posting at any of the BA having shortage of JAOs/AOs.

·       The restoration of transfer orders for posting JAOs/AOs from excess SSAs to shortage SSAs which are kept in abeyance is going on and most probably orders for filling vacant post in SSAs having shortage of JAOs/AOs/CAOs will be restored in this week itself.

 

18 JUL 21: DGM HR Mumbai writes to BA/SSA/NRU Heads calling for the documents required for confirmation of 132 JAOs and 119 JTOs throughout Maharashtra Circle including Non-Recruiting Circles.  Letter <<<>>> 

·        This work of confirmation of JTOs and JAOs is delayed since VRS 2019 and rearmaments in sections, officials and officers thereof. 

·        SNEA MH has been pursuing this issue continuously and in recent meeting with CGMT MH on 16/07/2021, we have again raised this issue and elaborated CGMT MH about undue delay in confirmation and dispute on handing over files among FC and Staff section wherein CGMT MH has directed GM HR Admn Mumbai to look into this matter and get it resolved.

·        With persuasion of SNEA MH, earlier also information called vide letter dated 24/10/2020, Copy <<<>>> and in response data information of about 40 Executives has been received by HR section and till information in respect of JTOs/TOs left out in the earlier letter and in this letter issued today is yet to be received.

·        The confirmation of 40 JTOs/JAOs can be issued at any time but with view that confirmation of all can be issued together in one stroke and hence the information about left out JTOs/JAOs is now called by giving time of one week to all units.

·        Some of JTOs/JAOs working in other Circles but recruited by MH Circle, but not yet confirmed are also requested to take up matter with their SSA/Circle and send details required for their confirmation by MH Circle to AD HRD Mumbai. The confirmation orders of all such JTOs/JAOs if not issued till today will be issued by MH Circle.

·        Though it is not mentioned in letter, the data/information with attested copies of concerned documents are to be first sent by email on adhrd2018@gmail.com and agmesttmh@gmail.com and hard copies are to be sent by post  to Shri. M. R. Snap, AD HRD, A wing, 4th Floor, BSNL Admn Bldg., Santacruz Mumbai 400454 concerned offices are sending all relevant documents at the earliest to HR section Mumbai.

·        All DS SNEA are requested to take up matter with SSAs/BAs /NR Circles concerned and see that information in respect of all these JAOs/JTOs and others who are not yet confirmed is sent within period of one week.

16 JUL 21:  Meeting with CGMT MH Circle to discuss current HR Issues: Shri. M.N. Kotambe, ACS SNEA MH and Shri. M. S. Adasul, CS SNEA MH had meeting with Shri. Ramakant Sharma, CGMT MH Circle on 15/07/2021 at 1730 hrs in his chamber to discuss the urgent HR issues. The meeting was held in presence of Shri. S.V. Nakhale GM HR Admn Mumbai and Shri. Aman Jaiswal, CE Civil and Ex GM HR Admn Mumbai.  

At the outset, we conveyed sincere thanks and gratitude to Shri. Ramakant Sharma, CGMT MH Circle  and his team for Restoring Tenure Request Transfer orders, Giving consideration to earlier Tenure completed period and choice not work at Tenure station again, Consideration of all requests for retention on grounds of ward studying in 12th Standard, calling for Fresh options for Non-Tenure stations, Consideration of Request for change of SSA in Tenure orders, Cancellation of double transfers to SSA and CNTXW Circle and for application of Tenure stations for Account wing at par with Telecom , Civil and Electrical wing. In response CGMT MH informed that his office trying to give consideration to all the genuine concerns expressed by SNEA and review has been done as per guidelines on the subject and discussions held thereof. Details of HR issues discussed are as follows.

1.     ERP Relieving of Executives under transfer from Tenure stations: We have narrated difficulties and hardship faced by the executives working at tenure stations as they are not being relived from Tenure stations even though some substitutes have joined. We requested for ERP relieving of all these executives as date given for same has been already over and work of review of orders in abeyance is delayed. CGMT MH informed that he fully agrees with concern expressed by us and difficulties faced by executives working at Tenure stations. He added that ERP relieving it is under active consideration and he has already conveyed instructions for same. But it is reported by some SSA/BA Heads having acute shortage of executives that till substitute is posted it will be difficult for them to relieve these executives under transfer to tenure stations. In conclusion CGMT MH informed that by next week the orders for filling vacant posts at shortage SSAs will be restored and then immediately process of ERP relieving of executives will be initiated and all left out/not relieved executives to and from Tenure stations will be relived through ERP by Circle Office Mumbai. 

2.     Undue delay in review of request Transfers from Non-Tenure Stations kept in abeyance: We have drawn attention of CGMT MH towards unrest among executives who are waiting for request transfers for last two years and how all are eagerly waiting for early restoration of the already issued transfer orders. The orders are kept in abeyance on 02/06/2021 and since then one and half moth passed and only Tenure station orders are reviewed till now.  CGMT MH expressed that he has repeatedly instructions GM HR Admn Mumbai to complete review fast, but officers under him are taking much time. He personally wants to complete review very fast and give final shape by restoration of transfer orders kept in abeyance. He firmly directed GM HR Admn Mumbai to take lead and work on the review of transfer orders to fill shortage of executives by coming week and also complete review of request transfers from Non-Tenure stations by next week. 

3.     Issues due to Calling Fresh Options without giving working Strength: We have drawn attention of CGMT MH Circle towards the issues created by publishing vacancy position in non-transparent manner wherein working executives, justified executives and excess shortage executives are not shown SSA wise, but in similar approach as happened earlier, options are called just by showing In and Out. We pointed out that in last meeting CGMT MH has assured to publish it by showing details and we have shared the earlier format published for it. CGMT MH informed that he has personally worked on strength of executives by discussions with all SSA/BA Heads. He added that after this publication of data, many of SSA Heads and SNEA has raised concerned and accordingly he has taken care and reduced number of executives to be transferred In and out from all SSAs. He added that now again there should not be dispute created at this stage. We have elaborated him that we are not creating dispute, but we have calculated proposed SSA wise executive strength for all SSAs and it is seen that the figures of working executives do not match with the figures considered as working by staff Section. Copy <<<>>>.  He firmly appealed to believe him as CGMT MH as he has taken efforts to keep transfers minimum and has elaborated the details to all BA Heads. CGMT MH expressed that no one wants transfer and everyone wants to be at the same place and he is getting calls for transfers every now and then from individuals, form political leaders, MPs/MLAs and this is not good culture and all have to be ready for transfers. Being Government servant, one has to move on transfers and help others who are already working with much difficulties due to shortage and SSAs having excess manpower has to spare minimum number of executives. In support of this say, CGMT MH has shown the details of exercise he has done for counting and calculations of SSA wise Executives strength. We responded that we never oppose transfers, but our request is to issue transfers in transparent manner and executives are ready for transfers if it is issues under uniform criteria and as per policy which is missing here. We requested that whatever figure he has decided as working strength may be published and we will not object on it to review, but for transparent working and mainly to have confidence among all executives, it is required to publish the justified strength, working strength and excess shortage. We have again shared copy of such data published earlier.  Copy <<<>>>.   We have narrated that such exercise was done regularly in earlier days at the level of AD, but it is stopped now. CGMT MH asked how it will be helpful at this stage as he has already given consideration and accordingly data is published. We have narrated some discrepancies in the calculations and elaborated that we have seen that in some of SSAs the excess executives are shown just because the working strength is counted wrongly. We also added that if the justified executive strength is taken into consideration, then the figure shown as working is higher than the practically working executives. We have narrated classic example of Nashik SSA, where total 107 executives are working, but practically there are only 98 executives working and how it can be excess executives in Nashik SSA against justified strength of 98 shown by Staff section. We have specifically elaborated that if there are working executives as counted by Staff section , we have no issue that excess executives are transferred, but we when there is practically shortage, then executives should not be compelled to transferred on name of excess. In our support we have shared calculation of Kalyan SSA Copy <<<>>> for telecom wing and Dhule SSA for account wing. We elaborated that in Dhule SSA working account wing executives are three, proposed strength is four and one is proposed out. If there are only three working Executives and proposed are three, then how one executive can be transferred as out in name of excess. It will create one shortage at Dhule SSA and again one will be posted to meet shortage, which is not correct. Same is case with Telecom wing and hence review needs to be taken.  CE Civil Mumbai who is looking of review of the transfers done in his period as GM HR Admn Mumbai informed that as per his data there are 107 executives working in Nashik SSA and shared break up this figure of Executives with total 107 and added that he has taken data from ERP. We have responded that we have taken this data from DS SNEA Nashik and these figures are also confirmed by GMT Nashik. Similar letters are written by other SSAs to correct the data. CGMT MH intervened and expressed that already matter of review of transfers is delayed and if we go to review entire process again and publish figures as fresh, there will be much delay in completing this exercise of review of transfers. He expressed that SNEA is demanding for early action for review of transfers and he also is of the opinion of restoration of remaining orders at the earliest and hence let the process move ahead. CGMT MH informed that he has personally done this exercise for deciding executive strength, he is aware about the issues faced by Big SSAs and further added that he cannot ignore the requirement of executives in SSAs having shortage of executives.  In conclusion CGMT MH expressed that there may be some discrepancies and it will be taken care, but at this stage there should not be any issue and demand for fresh publishing Executive strength of each SSA and appealed to let this ongoing process get completed at the earliest and issues if any will be taken care after restoring orders. 

4.     Addition of Justified strength for each SSAs against norms and guidelines issued by different Offices: We have drawn attention of CGMT MH Circle towards the fact that there are guidelines issued by BSNL CO for One Network and support teams at all BAs for CFA Copy  <<<>>> and for CM works.  Copy <<<>>> There are also special guidelines issued by Staff section Staff availability/requirements/structure w.r.t. mobile maintenance in selected SSAs. Copy <<<>>>. CGMT MH responded that all these guidelines are taken care and all BAs have posted the executives accordingly. We have narrated that form the In/Out data and actually working executives at BAs, we found certain discrepancies. CGMT MH replied that there may be certain issues and same will also be taken care to some extent, but at the same time he cannot ignore the SSAs/BAs having extreme shortage of executives and to balance the shortage, certain transfers are must. We have narrated that the working of Big BAs will suffer if transfers are issued without consideration to these norms. CGMT MH replied that he is aware about it and has discussed it with concerned SSAs and genuine proposals from these big BAs is already given consideration and will be taken care to extent possible.  

5.     Publication of options/requests received before issuing transfer orders: We have drawn attention of CGMT MH about the confusion among the executives who have submitted their willingness and are not able to understand where options are received at Staff section and taken into consideration. Hence it will be helpful if details of options received are published. CE Civil Mumbai added that there ae about 90 options received and data has been consolidated and ready but some of executives have given conditional/confusing options. CGMT MH informed that there is no issue in publishing options/requests received and directed GM HR Admn Mumbai informed to publish it as per his discussions with him. GM HR responded that data is ready and it will be published tomorrow itself.

6.     Publication of long stay list of Executives: We have reminded CGMT MH about publication of SSA wise long stay list of executives and mainly the list of executives who are coming under zone of transfers. It was opposed by CGMT MH and CE Civil Mumbai stating that individuals should know their position in long stay list and he should plan accordingly. We have narrated that for knowing position of an individual in long stay list, he needs to know the details of others. If it was matter of cadre like only JTO it was quiet possible, but here JE JTO and SDE are counted together. CE Civil Mumbai informed that they should have analysis and everyone knows who is senior and who is junior in stay. We added that it may be possible for small SSAs, but many not be possible for executives in big SSAs, but till there was reluctance in part of CE Civil Mumbai and CGMT MH also was of same opinion. We have added that when data is available with administration, there is nothing wrong in its publication and also put forward the facts that there are two types of JEs in BSNL and it is difficult to ascertain which JE is transferable out of SSA and which is not transferable and hence individuals are facing issues in deciding to submit option or not. If data is published with names which are coming under zone of transfers, more willingness may be submitted. But many executives are not submitting willingness as they do not have any idea about their position in transfer and continue to submit the representations after issuing transfers. After elaborate discussions, CGMT MH directed GM HR Admn Mumbai to publish list of JEs who will be due for transfers and list of JEs who will not be transferred out of SSA and there should not be any issue for other cadres as data is already published.

7.     Consideration of JAO/JTO Rule 8 /Rule 9 requests: We have narrated the difficulties faced by the JTOs/JAOs who have completed five years and opted for Rule 8 transfers. We reminded that this matter is being discussed for last one year and request of 14 JAOs and five JTOs have been already proved by CGMT MH in Dec 20 and consent also has been received from all these Circles and since then only matter of formal approval of relieving order was issued. CGMT MH expressed that there is already shortage of executives and he has already decided not to give consideration to any Rule 8 transfers. CGMT MH added that though there may be excess JAOs/AOs but as compared to works in MH Circle, it is difficult to relieve them. He added that there is important works like EB in MH Circle which is generating revenue. He further informed that he has already decided to post some JAOs/AOs in EB section as majority of revenue is coming from EB section and there is need of keen persuasion of revenue matters. We responded that we have no issue in posting in EB and it is good that revenue matters will be taken care by JAOs/AOs. At the same time we have brought to his notice that Maharashtra Circle has sufficient number of JAOs/AOs to consider these pending Rule 8 requests even by taking care of EB works.  Circle wise Strength of AOs/JAOs <<<>>>.   We have also updated that about 84 JAOs of Maharashtra Circle are working on deputation to different Circle under Rule 9 transfers and they are supposed to come back to MH Circle as it is temporary transfers and none of them have completed five years period. The JAOs whose Rule 8 transfers are pending now have continuously worked for more than five years in MH Circle, their request are approved long back, consent also received for concerned Circles. All are eagerly waiting for their relieving for which file was processed to him in Jan 2021 and he has returned with remark to reprocess after March 21. But same is reprocessed and returned back again and matter is not decided yet. CGMT MH directed us to discuss it with GM Fin Mumbai as he has certain issues in relieving these JAOs under Rule 8 transfers. We have informed CGMT MH that yesterday itself, we had discussions with GM Fin Mumbai and requested him for consideration of Rule 8 request transfers. GM Fin Mumbai has informed that this work is with GM HR Admn Mumbai and HR section has to work on it but informed that he is having shortage of JAOs/AOs. We have detailed discussions on it and finally GM Fin Mumbai has assured to review overall working and think on consideration of Rule 8 transfers. CGMT MH directed GM HR Admn Mumbai to discuss JAO Rule 8 transfers with GM Fin Mumbai and decide accordingly. Pending JTOs/JAOs Rule 8 Requests <<<>>>. On JTO Rule 8 transfers, CGMT MH was of the opinion that there shortage of executives and it is not possible to give consideration to Rule 8 transfers of JTOs. We have elaborated that the situation will continue as it is and BSNL has managed the works when thousands of Executives have left BSNL through VRS. Now it is matter of total eight JTOs out of about 1900 executives working in Maharashtra Circle and it can be managed. Further, we reminded that MH Circle has issued Rule 8 transfer order in lots ranging from 50 to 100 at a time in past, but till works are managed locally. This time also works can be managed locally and requested CGMT MH to issue orders and let final relieving may be decided by Units/SSAs by local rearrangements. We added that if we keep on hold such request then there is no chance to get substitute as BSNL has already given VRS to thousands of executives and there is no chance of immediate recruitment of JAOs/JTOs. In conclusion CGMT MH assured to issues the orders once the ongoing process of transfer posting is completed. We narrated that by looking at ongoing process, it may take more time but CGMT MH informed that entire work of transfer posting including restoration of transfer kept in abeyance will be completed within fortnight and its matter of just fortnight and there should not be any issue.

8.     Exclusion of names of Rule 8 JTO/JAOs from long stay transfers: We have also brought to the notice of CGMT MH that names of some of JTOs/JAOs who have requested for Rule 8 transfers are under zone of transfers and orders of some JTOs are issued and kept in abeyance. When they are waiting for Rule 8 transfers, they should not be punished by another transfer and it will also not be useful for BSNL and hence their names should be excluded from the list of long stay transfers if appearing anywhere. CGMT MH accepted our request and directed GM HR Admn Mumbai for same and CE Civil Mumbai informed that it is being take care and no JTO/JAO under Rule 8 transfer will be transferred in as longest stayed executives.

9.     Counting of strength of Absconding/Retiring executives while counting Executive strength:  We have brought to the notice of CGMT MH that the executives who are due for retirement as well as absconding from duties are taken into consideration of executive strength and hence the actual requirement of SSA and available strength is not matching as given by Circle Office. We requested to exclude the names of Executives who are absconding and retiring during this year should be excluded from the count of working strength. CGMT MH agreed to concern expressed by the association and directed GM HR Admn Mumbai to take care of it and exclude all such executives.  CE Civil Mumbai added that same is being taken care and any left out case same will be given consideration.

10.            Unwanted proposal for transfers of DEs from Shortage SSAs to Shortage to SSAs: We have brought to the notice of CGMT MH that in stage approach, it is proposed to transfers DEs/AGMs from SSAs having shortage to SSA having shortage. When there are directions for filling vacant post of AGMs/DEs by local Looking After Arrangements, in wrong approach it is proposed to transfer more DEs from shortage to shortage SSAs. In response CE Civil Mumbai informed that these DEs/AGMs being transferred from SSA having Shortage to SSAs having shortage are senior AGMs/DEs who are in zone of consideration of DGM LA arrangements. There is shortage of DGMs in many SSAs and hence it is proposed to transfers DEs/AGMs to fill vacant post of DGMs under LA arrangements and on transfer under long stay they will be given higher responsibility of DGMs. It was confirmed by CGMT MH that transfers in AGM/DE Cadre from SSAs having shortage will be minimum and no AGM/DE will be transferred if his name is not under zone of consideration of DGM LA.

11.            Issue in posting of IFA to BA Heads: We have narrated CGMT MH how issues are being created in posting of IFAs and request Shri. Mohite AO Aurangabad is being shunted in file and repeatedly rejected even though he is senior. CGMT MH informed that there are certain issues raised by GM Fin Mumbai and he has followed the recommendations of GM Fin Mumbai not to post Shri. Mohite as IFA Aurangabad. WE have narrated that there is no any such issue as Shri. Mohite is working smoothly and some wrong information is being propagated about him that to be without any proof and evidences. We further added that if he is guilty, then take action against him and decisions should not be taken just on basis of rumors spread about any officer. CGMT MH informed that he to believe GM Fin Mumbai and directed us to discuss with him the issues. We responded that we have already discussed issues with GM Fin Mumbai and he has also accepted that Shri. Mohite is senior, but is not ready to give him charge of IFA Aurangabad. We further added that by understanding the issues created for him Shri. Mohite has requested for change of SSA from Aurangabad to Goa and his request may be given consideration. CE Civil Mumbai added that there may be issue of again posting him as IFA in Goa and Ahmednagar as GM Fin Mumbai may have issues in posting him as IFA. We demanded that if he is senior and having vigilance clearance, he should be given charge of IFA and if he is junior and having any official issue of giving charge of IFA, he should not be deprived form responsibility of IFA just for fact that someone is spreading wrong information without official records. After elaborate discussions on this issue, finally CGMT MH directed to have review of the case and decide on request of Shri. Mohite for posting as IFA and his request transfers.   

12.            Dispute between Staff and Account wing and pending issues and delay in Confirmation of JAOs: We have drawn attention of CGMT MH on the long pending dispute between Account and Staff section and how the files of FC section are under dispute since VRS 2019 and we have discussed this issue with all DGM FC Mumbai, DGM TR Mumbai, DGM Legal Mumbai, GM Fin Mumbai and GM HR Admn Mumbai, but matter is not yet resolved. While DGM FC, DGM TR and GM Fin Mumbai have informed that all the files are handed over to staff section and DGM legal is having its custody and keys of the cupboards and he cannot deny that the receipt of FC section files. In recent one occasion during lockdown, DGM TR Mumbai has shown all files to DGM Legal and his team and now also keys are with DGM legal Mumbai and matter needs to be deiced by DGM legal Mumbai. It was also informed by both DGM TR and DGM FC Mumbai that then and last JAO FC Mumbai is working as JAO Admn Mumbai and he was last custodian of files and hence GM HR/DGM legal has to take care of it and there is no role of Account wing as claimed by DGM legal Mumbai. We added that in our last meeting with GM Fin Mumbai after elaborate discussions, he has directed DGM TR Mumbai to handover the files one by one to DGM legal Mumbai and settle the issue. When we discussed it with DGM legal Mumbai he has denied that he has received file. We have brought to his notice that DGM TR /FC Mumbai are ready to handover file fresh as desired by him and he should take over it or make arrangement for same. But DGM legal Mumbai denied for taking files now and directed us to take up matter with CGMT MH as his discussions with GM Fin Mumbai has not given any result and matter cannot be resolved till CGMT MH intervenes in this high level conflict going for long time. We added that after discussing with all and mainly as directed by DGM legal Mumbai we are taking up matter with CGMT MH with request to resolve this conflict continued for last one and half year. CGMT MH asked details from GM HR Admn Mumbai and he informed that matter is recently discussed with him and he will look into it. CE Civil Mumbai responded that the files are not handed over but only one letter is given to PA of GM HR Admn Mumbai and JAO FC is posted as JAO Admn and given other responsibilities.   He confirmed that this dispute is going for long time and not yet resolved after repeated discussions on the issue. He added that he was taking care of issues on data available with him and there are no much issues which has relations to files. We have elaborated that the work of confirmation of JAOs is pending for long time for want of the personal files and files related to recruitment of JAOs. Same is case with individual grievances and we have updated that formal approval in one of the resignation request by JAO is pending since long just want file processed earlier and many other cases of resignation received after that are finalized. We made it clear that no one is taking responsibility of it and individual JAOs/AOs are sufferers. CGMT MH expressed displeasure such ongoing conflict and directed GM HR Admn Mumbai to discuss this issue with GM Fin Mumbai and get it settled without any further delay. He also expressed that such small issues should be settled at GM level and there is no need of intervention from CGMT MH. 

13.            Issues in Consideration of Account wing request for change of SSA/Retention: We have drawn attention of CGMT MH for long pending request of JAOs/AOs for change of SSA/Retention on their transfers issued earlier. We added that SNEA MH has submitted issues in detail about discrepancies in these transfers and till no consideration is given except in few cases. CE Civil Mumbai informed that review is going on it and shortly all such requests will be given consideration along with other transfers proposed for JAOs/AOs.

14.            Consideration of Request Transfers of Electrical and Civil wing: We have once again drawn attention of CGMT MH that though request transfers of Telecom and Account wing are given consideration, there is no action taken for Civil and Electrical wing as till issues are taken care by concerned verticals and only formal letter is signed by DGM legal Mumbai. When we are discussing any issues with these transfers DGM legal raises hands stating that he has not issued any orders and has only signed order. Disputes if any should be discussed with convened verticals. CGMT MH directed GM HR Admn Mumbai to have review of the works and transfer posting may be proposed by Civil Electrical wings, but he has to look into HR aspects and transfer policy guidelines and Staff section is responsible for overall issues of transfer posting and should take care accordingly. CE Civil Mumbai informed that he is ready with the proposal and assured to give it final shape at the earliest. CGMT MH directed GM HR Admn Mumbai to look transfers of Electrical wing also and decide accordingly.

15.            Consideration of request of Electrical wing JTOs transferred to Telecom wing: We have narrated the difficulties faced by the JTOs in Electrical wing who are transferred from Electrical wing to Telecom wing and how their request are not being given consideration either by Electrical wing or by Telecom wing. We have narrated the facts that they are relieved from Electrical wing but concerned SSAs have not given works as they are due for transfers. Some of them have completed more than seven years in working SSA and are waiting for consideration of their request transfers, but instead of request transfers, they are transferred to Telecom wing. We elaborated that such cases are from Dhule, Bhandara and Nagpur SSA where already Telecom wing executives are declared as excess and there is need of review of this issue and given consideration of their requests. CGMT MH directed us to take up matter with CE Electrical Mumbai. We have responded that we have already discussed this issue with CE Electrical Mumbai has directed to take up matter with GM HR Admn Mumbai. The proposals received from SSAs are being shunted between Staff section and Electrical wing and issue is not decided and concerned executives are in trouble. CGMT MH directed GM HR Admn Mumbai to discuss this matter with CE Electrical Mumbai and put up matter accordingly to him.

16.             Review of Transfers from yearly transfers to Quarterly transfers: In conclusion of discussions, we have requested CGMT MH that majority of issues during this transfer are observed as the request transfers are not given consideration in time and bulk transfers are issued in one lot. This process is handled at BSNL Corporate Office on quarterly basis and no such issues are observed in any of transfers. In Maharashtra Circle also same procedure was followed earlier. Now BSNL OTP Portal also giving consideration to all request transfers quarterly, but this widely accepted quarterly transfer concept is not followed in MH Circle since last 2-3 years. Hence transfer orders are issued in bulk causing mass unrest among executives and we are also compelled to take up all such issues created due to mass transfers. CGMT MH also expressed that he also is of the same opinion and there should be routine procedure for issuing request transfers and executives held up in difficult stations should not suffer. He has seen much issues in this transfers and opinioned that if transfers are issued in routine manner there will not any bulk transfers and unrest thereof. He directed GM HR Admn Mumbai to work on it and follow the procedure of Quarterly transfer Orders for all request transfers.

After elaborate discussions on all current HR issues for about one hour, the meeting concluded at about 1830 hrs and we conveyed thanks to CGMT MH, GM HR Admn Mumbai and CGMT MH for giving consideration to concern expressed by SNEA and assured for further co-operation in implementation of transfers orders issued as per the transfer policy guidelines in uniform policy manner which are equally applicable to all executives. In conclusion, CGMT MH informed that he is always ready for consideration of all genuine issues raised by association and firmly directed GM HR Admn Mumbai to take over command of remaining review of transfer order & related works and to complete the process of review of the Transfers kept in abeyance within period of fortnight.  

 

15 JUL 21:  SNEA MH writes to Shri. Ramakant Sharma, CGMT MH Circle elaborating facts and figures about criminal conspiracy by AD Admn Mumbai and AO Salary Mumbai in extending facilities to particular Associations by misuse of authorities of self and authorities of higher officers up to level of CGMT MH.  Letter <<<>>>     Enclosures <<<>>>

·        Of the late, AD Admn Mumbai has issued letter for grant of facilities to the executives associations on 30/06/2021 and SNEA MH has immediately brought to his notice, the issued created by issuing the facilities.

·        But AD Admn Mumbai ignored same and did not respond it. Then the issues were brought to notice of GM HR Admn Mumbai on 06/07/2021 and it was assured for corrective action, but nothing was done.

·        Then again SNEA MH has brought it to the notice of GM HR Admn Mumbai and DGM Admn Mumbai onn09/07/2021 and in and immediate action all these letters are withdrawn on 09/07/2021 late evening.

·        SNEA MH has analyzed issue and it found that AD Admn Mumbai has acted out of his powers and issued the letters with his signature without approval of GM HR Admn or CGMT MH

·        It is seen that GM HR Admn Mumbai has returned file with remark “to discuss” and AD Admn Mumbai has not bothered about and issued letter without any discussions or information to GM HR Admn Mumbai.

·        GM HR Admn Mumbai and other responsible officers comes to notice about such letters issued and malafide action thereof only when SNEA MH has brought to notice of them have pointed out it.

·        On further analysis of issues, surprisingly it is found that AO Salary who is also office Bearer of newly formed District Body has played with financial activities and deduced Association subscription of only particular Association since the window closed in June 2020 to June 2021 when window for changeover of membership or new membership was closed for all associations.

·        Further, when District Body is not yet approved the facilities for grant of immunity are granted by certain officers in Staff section in joining hands with all such malafide illegal actions.

·        SNEA MH has written to CGMT by giving facts and figures about criminal conspiracy by AD Admn Mumbai and AO Salary Mumbai in extending facilities to particular Associations and deducting association subscription of particular association continuously for one year, with malafide intention and deliberate actions by misuse of authorities given to them and also misuse of powers of higher officers including CGMT MH.

·        It is crystal clear that these illegal, malafide financial and administrative actions Certain financial irregularities continuously going on Circle Office Mumbai and unfortunately even after bringing all such issues to the notice of controlling officers no action has been taken, but both these officers are given free hand to play with BSNL records and accounts for benefit of self and association to which they have accepted membership recently.

·        SNEA MH has demanded for to depth investigation of entire malafide actions and issues by both these officers and Office Bearers of association by team of officers specially nominated for it or by team of officers from Vigilance and take suitable action against officers who are involved in this criminal conspiracy going for last one year.

14 JUL 21: DGM Legal Mumbai issued orders for cancellation/retention of transfer orders of executives who were under transfer from Non-Tenure Stations to Tenure Stations.  Letter <<<>>> 

·        All these executives have requested for cancellation of transfer orders on grounds that they have already worked at tenure stations and retention on grounds that ward is studying in 12th Standard and appearing for Board Exams in year 2021-22 and immunity as prominent OB of the recognized association.

·        SNEA MH has taken stand for review of transfer orders as per BSNL guidelines on the subject and pursued successfully for getting orders reviewed as per request of individuals well within the guidelines.

·        The ERP relieving of the executives working at Tenure stations was delayed due to this review and now the data of relieving of executives under transfer is being verified with SSAs by Staff section.

·        On confirmation of relieving status of the executives from Non tenure SSAs, the orders for ERP relieving of left out executives will be issued from Circle office Mumbai.

12 JUL 21: AD Admn Mumbai issued orders for withdrawal of all four orders for grant of facilities to District Body CO Mumbai and Circle Body SNEA and AIGETOA.  Withdrawal Order <<<>>>  Orders withdrawn <<<>>> 

·        These orders are withdrawn as SNEA MH has drawn attention of GM HR Admn Mumbai on serious discrepancies and biased approach in granting facilities to the associations without approval of competent during window open for changeover of membership of association.

·        The period of Circle Body of SNEA MH has been deliberately reduced by one year and no corrections were issued even after it was immediately reported to AD Admn Mumbai.

·        Further, certain issues are deliberately overlooked while granting facilities to District Body of AIGETOA Mumbai and no action was taken on serious violations done by certain officers in granting facilities in such biased approach.

·        There are no issues as such reported in facilities granted to SNEA Mumbai and AIGETOA MH Circle, but these letters also withdrawn due to fact that same are issued without knowledge and approval of CGMT MH Circle.

·        Matter was reported to DGM Admn Mumbai and GM HR Mumbai on 06/07/2021 and both have assured to look into it but no action was taken.

·        Finally, on 09/07/2021, SNEA MH has once again discussed this issue with GM HR Admn Mumbai and drawn his attention towards conspiracies being created by certain officers in his office.

·        GM HR Admn Mumbai was surprised to see such orders issued as he has not given approval for issuing orders and returned file with remark “to discuss”.

·        But AD Admn Mumbai has interpreted this remark ‘to discuss’ at his own and issued orders with his signature and even after matter was reported to him he has not acted on it for one week with malaise intention in mind.

·        As per guidelines on the subject followed in Maharashtra Circle, these orders are issued with approval of CGMT MH Circle and with signature of DGM Admn Mumbai.

·        But in this case, it is not approved even by GM HR Admn Mumbai and file has not reached to CGMT MH and hence no question of its approval by CGMT MH, but orders are issued directly by AD Admn Mumbai by using powers of CGMT MH by taking CGMT MH as granted.

·        This has been done to get undue favor or for spreading wrong message and misleading information among the executives during period of window open for changeover of membership.

·        During discussions GM HR Admn Mumbai and DGM Admn Mumbai have understood the seriousness of the issues and deliberate violations done by AD Admn Mumbai and have immediately taken corrective action to withdraw the wrong orders issued by AD Admn Mumbai.

·        It is not only matter of issuing illegal and out of power orders by AD Admn Mumbai but there are serious financial issues w.r.t. deduction of subscription only for particular association by AO salary Mumbai who is one of the office Bearer of newly nominated District Body of AIGETOA Mumbai.

·        We have narrated all these issues with supporting documents and hence GM HR Admn Mumbai has issued direction to withdraw these letters and we have demanded that only withdrawal of the wrong and illegal orders is not solution and suitable actions needs to be taken against the said officers who have deliberately violated authorities granted to them, use authorities of higher officers without their approval/permission just with malice in mind to give extra benefits to the association to which they have joined recently.

·        It really surprising that these officers dares to use authorities of GM HR Admn Mumbai and CGMT MH and all their controlling officers are unaware about it and it comes to their notice only when it is pointed out by SNEA MH.

·        Let us hope the matter is investigated to depth and suitable action is taken against officers who will be involved in this scam as per findings of investigation so that no one dares to work in such biased approach just for gaining benefits to the association they belongs or to project their image as leaders of association giving wrong message that CGMT MH and GM HR Admn Mumbai are powerless and have work only as per directions given by them

 

 12 JUL 21: AD Staff A Mumbai issued third extension for DGM LA orders for Telecom wing and now it is extended up to 31/08/2021.   Letter <<<>>> 

·        As the fresh DGM LA arrangements could not be finalized for last four months the original order for 179 days is now extended for more 120 days.

·        Due to this extension, the executives working as DGM LA will be continuously working as DGM LA for more than 270 days from original orders dated 26/11/2020. 

·        Many officers given LA Order in original Order dated 26/11/2021, are transferred to other SSAs and have joined and there is need of modification about their SSA accordingly, but nothing is mentioned about it. 

·        Two AGMs are transferred out of Circle and have joined assigned posting on transfer, but till their DGM LA order is given extension.

·        Some AGMs posted as AGM Operations are also transferred, but as the original order is extended without any such corrections, their names will be shown against the SSA where they were posted as SSA Heads before transfer.

·        As only extension orders are issued and some names are dropped on name of Vigilance clearance, some post have become vacant, some were vacant since last DGM LA Orders there are many post of DGMs vacant and CGMT MH also has given instructions for issuing fresh/additional DGM LA Orders to fill vacant posts, but same are not being followed at below line as if the instructions of CGMT MH has no meaning.

·        It seems that without taking much pains and efforts for review, the simple funda of extension after extension that to be without any break of single day is being used by Staff section and this may be challenged at any time.

·        Let us hope that the review of DGM LA is done before 31/08/2021 and fresh orders with incorporations of changes required and this will be last extension to old DGM LA order.

 

12 JUL 21: AD Staff A Mumbai issued third extension for DGM LA orders for finance wing and now it is extended up to 31/08/2021.   Letter <<<>>> 

·        The original DGM LA Orders for Account wing was issued on 28/11/2020 for period of 179 days and there after no extension order was issued in May 2021 and since then all these officers were working without extension order.

·        It is reported that some individuals have managed to get issued extension orders at their offices /units, but general extension order was not issued and same is issued now after period of two months.

·        As per this orders, these executives will continue to work as DGM without break for more than 179 days period as mentioned in LA arrangements.

·        All such issues which normally taken care while issuing any extension order are not issued and entire team from AD to CGMT MH is new and orders are reviewed in casual approach to complete office formality.

·        As per restricting norms there is need of separate CAO TR and CAO Finance as well as DGM Fin in all BAs , but only DGM Fin are posted under LA arrangements and no CAOs are posted. Many other AOs also can be elevated as CAO, but same is not being taken care and only few orders of CAO LA are issued on pick and choose basis by Circle Office, while powers for same are with BA Heads. 

·        The date mentioned in reference letter number is wrong and it should be 28/11/2021 instead of 18/05/2021, for which corrigendum will be issued.

·        Let us hope that Staff section give importance to Account wing also and take corrective action as per BSNL CO guidelines by issuing fresh DGM LA Orders and BA Heads issue CAO LA Orders as per guidelines and availability of posts in all SSAs/BAs and units.

 10 JUL 21: Meeting with Shri. S.V. Nakhale, GM HR Admn Mumbai: Team SNEA MH consisting Shri. A. Y. Kesarkar, JS CE SNEA MH, Shri. M. N. Kotambe, CS SNEA MH and Shri. M. S. Adasul, CS SNEA MH had meeting with Shri.  S.V. Nakhale, GM HR Admn Mumbai on 07/07/2021 wherein the following issues were discussed in depth.

1.     Biased approach and misuse of authorities by certain officers in Admn and Account section in granting facilities to Associations: We have brought to his notice the malpractices done by certain Officers in Admn Section and Account section in granting facilities to the associations. We have narrated the deliberate issues crated by these officers while granting facilities to SNEA MH and AIGETOA Mumbai. We also asked what is need of issuing such specific letters which were not issued for last one year when window for changeover of membership of association is open and pointed out that some nexus is going on this matter for last six months and these letter at this specific time are final action of illegal and biased activities going on for last one year. It was to our surprise that GM HR Admn Mumbai informed that he has not yet approved the proposal in file for granting/extension of facilities as per BSNL REA Rules and there is no question of issuing such letters. We have brought to his notice that there are four such letters issued on single day 30/06/2021. GM HR Admn Mumbai also was surprised and informed that he returned for back with remark to discuss and proposal is not yet approved. We have handed over him  copies of all four letters issued by AD Admn Mumbai and how he can say that he has not yet decided on the proposal. We also narrated case by case, how undue favor is done in granting facilities to AIGETOA Mumbai Branch and how the period of SNEA MH has been deliberately reduced by one year. We also added that after issuing letter on 30/06/2021, late evening, immediately on 01/07/2021, these issues has been brought to notice of AD Admn Mumbai and later to DGM Admn Mumbai also. Both have assured to have corrective action by withdrawing these letters and issuing fresh letters, but till no action has been taken for last one week. We have also elaborated how AD Admn Mumbai and AO Salary Mumbai have taken certain actions beyond their powers for illegal deduction of membership of association when window for membership is not open. We have also elaborated with facts how the AO Salary Mumbai has misused the ERP authorities given to him to deduct subscription of AIGETOA Mumbai by deliberate violation of BSNL REA Rules and guidelines for deduction of subscription. We also narrated that AO Salary and AO Admn Mumbai are the responsible for checking that BSNL REA rules are not violated in granting facilities as well as checking that no subscription of any association is changes when the window for same is not open. But it’s unfortunate that the salary deduction of both these officers have been stopped for association to which it was deducted and fresh deduction has been started for AIGETOA Mumbai. Both are very active office Bearers of AIGETOA Mumbai and hence have taken such illegal actions and steps in favor of the association towards they have accepted membership as well as leadership.  GM HR Admn Mumbai was astonished to see such activities happening under him without his knowledge and was worried about the happening going on is office. After understanding the depth of criminal conspiracy going on, he assured to look into the matter personally and assured to withdraw these letters and issue fresh letters as per the norms and guidelines for granting facilities to associations recognised under BSNL REA Rules. We demanded that only withdrawal of letters and issuing fresh letters is not the solution, but action needs to be taken against the culprit officers who have deliberately violated the powers delegated to them and misused powers of GM HR Admn Mumbai and CGMT MH in grating facilities to associations in biased approach. GM HR Admn Mumbai assured to take suitable action against these officers if found guilty of misuse of powers and authorities and also assured for issuing corrected orders for grant of facilities to the associations.

2.     Undue delay in Consideration of JAO/JTO Rule 8 /Rule 9 requests and hardship faced by these executives: We have drawn attention of GM HR Admn Mumbai towards long pending issue of JTO and JAO Rule 8 transfers and requested him to consider Rule 8 requests submitted by all JTOs/JAOs. GM HR informed that these us shortage of executives in Telecom as well as account wing and hence CGMT MH has decided to keep on hold all Rule 8 Requests. We have narrated that majority of cases of Rule 8 transfer of JTOs/JAOs are already approved by CGMT MH Circle in December 2020 and consent from other Circle is also received by Staff section and only issue pending is the formal orders for relieving these JAOs/JTOs. GM HR informed that there many such cases and they cannot be relieved at this time. We have brought to his notice that there are no more cases of request transfers either in JAO or in JTO Cadre. There are only eight Rule 8 request of JTOs and only 18 Rule 8 requests of JAOs and its very small figures as compared to total working strength of executives in MH Circle. Detailed List <<<>>>. Out of total eight request of JTOs , five cases are already approved by CGMT MH Circle  in month of December 2021 and three cases are kept on hold by them GM HR Admn Mumbai  and hence are yet to be processed for approval of CGMT MH. Same is case with JAOs Rule 8 Transfers as Out of total eighteen request of JAOs , Fourteen cases are already approved by CGMT MH Circle in month of December 2021 and three cases are kept on hold by them GM HR Admn Mumbai and not even processed for approval of CGMT MH.  Important point is that consent for eight JTO Rule 8 Request and 14 JAO Rule 8 requests have been received from concerned Circles and naturally all of them needs to be relieved for their choice circle but none of them is relieved for last six months and all of them are feeling cheated by staff section officers by repeated assurances for issuing relieving orders. Many have informed that AD Staff A Mumbai and DGM legal Mumbai are informing that all the Rule 8 requests are kept on hold as there is shortage of executives in Maharashtra Circle and it cannot be confirmed when it will be issued. GM HR added that he has taken information on this subject and added that as there is shortage of executives in Maharashtra Circle, CGMT MH has decided not to relieve these officers. We asked him till what time it will be kept on hold and what are steps being taken for arranging substitute for these JTOs/JAOs. He added that there is no chance of getting substitute but some JTOs/JAO on rule 8 may be called back. We categorically brought to notice of GM HR Admn Mumbai that it is wrongly projected that there is any relation between Tule 8 and Rule 9 transfers.   Further it is also wrongly projected that there is shortage of JTOs and JAOs in MH Circle. We have handed over him the Circle wise data of JAOs/AOs working all over India. Copy <<<>>>. We have categorically pointed out that MH Circle has total 348 JAOs/AOs and if we add JAOs on deputation it comes to be 432. This is highest figure among all Circles and hence there is no shortage of JAOs in Maharashtra Circle, rather there are excess JAOs in Maharashtra Circle as compared to all other Circles. Same is case with JTOs and Maharashtra Circle has higher number of JTOs among the circles. Also now MH Circle has started counting combined stay of JEs/JTOs and SDEs together, which comes to be about 2000 numbers. Hence it is not difficult to relieve eight JTOs out of combined strength 2000 Executives. GM HR was surprised to see these figures and factual position and was doubtful about these figures. We have cleared him that we have taken the data of account wing from ERP and Telecom wing data is already published by his office and hence it is authentic and if required he can confirm it from ERP.  GM HR Admn Mumbai informed that he is not aware about these figures and if it is the case, then there should not be issue in consideration of requests. We requested him to bring it to the notice of CGMT MH with these figures, in response GM HR informed that he has already some preliminary discussions and CGMT MH has directed him to wait till the within Circle transfer orders are issued. We have responded that within Circle transfer orders cannot be reason for withholding Rule 8 transfers. Rather it is need of time that Rule 8 transfers needs to be given consideration before the within Circle transfers as names of some of JAOs under Rule 8 are under zone of transfers due to restricting of SSAs and BAs. Also, it is better that these JTOs/JAOs are not counted in strength of any SSA as their cases are already approved for transfer. GM HR Admn Mumbai agreed to the views expressed by SNEA and assured to have discussions with CGMT MH and he has no issue if CGMT MH agrees for same. We have elaborated that CGMT MH is kind enough to consider all Rule 8 requests, if the files are processed with facts and figures. But unfortunately files are processed with inadequate information and certain officers are giving misleading information to CGMT MH that these is shortage of executives in Maharashtra Circle and requested him to direct AD Admn A and DGM legal to process the files with factual figures and we are confident that if files are processed with factual position, CGMT MH will definitely understand pains and difficulties faced by these JAOs/JTOs and will definitely approval the proposal. In conclusion, GM HR Admn Mumbai assured to discuss this issue with CGMT MH as fresh and to take suitable action to release Rule 8 request transfers of all JAOs/JTOs at the earliest.

3.     Publication of SSA wise Working Executive strength: We have narrated that the revised SSA wise In and Out data is nothing but cheating of executives as nothing clear has bene given about working strength. GM HR Admn Mumbai informed that he has seen the said “in out” letter and he also is surprised to see that nothing is clear from this letter. He at his own added that the letter should have SSA wise figures under different columns showing justified strength, working strength, Excess shortage so that everyone gets clear and transparent picture about the executive’s strength in any SSA. He added that now data is published and hence nothing can be done on it and all these activities are done by Ex GM HR Admn Mumbai and he is not yet involved in it. He further added that it should have bene brought to his notice before issuing these letters. We have added that we have informed it to DGM legal Mumbai about showing working and justified strength, but he said that he is following orders of old GM HR to go with In out figures only and he has not received any order either for old GM or new GM to change the format. We have reminded that this has been assured by CGMT MH in online meeting with all associations, DGM Legal has informed that he is not aware about what CGMT decides and he has been told by old GM HR Admn Mumbai to go ahead only with IN and Out figures and he is doing so. We have handed over the copies of SSA wise Executive strength published earlier in MH Circle. After having look at it, GM HR informed that this is correct method and shared that SSA wise data needs to be published in such format in totally transparent manner.  We also narrated that here also files is being moved with wrong information and requested him to take over the control on all such acts as GM HR Admn Mumbai as he is answerable to all this wrong acts to CGMT MH. This wrong data has already caused issues and hardship to executives and similar action to publish same data with minor changes has no meaning at all. We also elaborated to GM HR Admn Mumbai case by case basis how the proposed strength is shown wrongly and more confusion by adding total figures from JE to DGM together, by proposing transfer of DEs from shortage to shortage SSA, wrong working figures inclusion of names of JTOs/JAOs under rule 8 and all India transfers etc. After patience listening GM HR Mumbai has assured to discuss this issue with CGMT MH and assured to have corrective action for transparent working by publication of data.     

4.     Publication of long stay list of SSAs having excess Executives: We have narrated the issues due to non-publishing revised list of SSA wise longest stayed executives including JEs and how the executives are under confusion and unaware about their position in long stay list. Further in counting of stay of JEs, very critical issue is observed that some JEs are SSA Cadre and some are of Circle cadre and SSA Cadre JEs are not considered in transfers out of SSA. Till the names of JEs under zone of transfers and not in the list of transfers, it is difficult for individual to access his her position in the long stay list. We added that individual cannot access data from ERP or data being taken into consideration by staff section for issuing transfer orders and till this data is published no one can understand and come forward willingly and submit options. We further added that these issues were discussed in depth with meeting by CGMT MH with all associations and it was directed by CGMT MH to publish the long stay lists, but same is not done by DGM legal Mumbai and even though said data is available with him on which he has processed data of In Out transfers. After understanding concern expressed by SNEA, GM HR Admn Mumbai expressed that he is not aware about the discussions held in past in online meeting but has assured to discuss this issue also with CGMT MH and take corrective action.

5.     Publication of list of Request transfers and Options received:  We have requested GM HR Admn Mumbai to publish list of request transfer from Non-Tenure to Non-tenure SSAs which will be given consideration showing their names, working and requested SSA. We also requested to publish the list of options/ willingness received by Staff Section for filling vacant posts in different SSAs. This will ascertain that the email request/option submitted by individual is taken into consideration by staff section or not and it will be transparent working. This will help individuals to analyses the working strength of his working SSA/ requested SSA or his position as substitute under incoming request transfers.  GM HR agreed to our concern and informed that the review of transfers is being done by EX GM HR Admn Mumba and he is not involved it. We have responded that as GM HR Admn Mumbai, he has to take responsibility of review also and issues cannot be left to others who are not holding the charge as it is matter of important HR issues applicable to all. Finally, GM HR Admn Mumbai assured that he will discuss it CGMT MH and bring to his notice the concern expressed by association and see what best can be done on this front.   We brought to the notice of GM HR Admn that the last date for submission of options in 09/07/2021 and if issues are cleared before this date it will be easy for all executives under zone of transfers to decide their position and opt accordingly. GM HR Admn Mumbai assured to discuss all these issues at the earliest and added that if CGMT MH agrees then there should not be any issue of last date of options. 

6.     Purifying the list under consideration for transfers by exclusion of certain categories of executives: We have drawn attention of GM HR Admn Mumbai that in list transfer orders kept in abeyance it was found that names of the executives who have opted form out of Circe transfers were added making it double transfers for them and loss to BSNL of issuing such transfers at company cost. To avoid such incident again, we requested him for exclusion of names of executives who have opted for inter Circle transfer under OTP Portal, executives under transfer to All India Hard Tenure Stations, executives under Rule 8 Transfers, and executives under transfer to CNTXW Circle and avoid double transfers. GM HR Admn Mumbai agreed to concern expressed by SNEA and assured to take necessary action for exclusion of all such names.

7.     Official letter for change of tenure stations of Account wing: We have elaborated that as per discussions held by SNEA MH with CGMT MH for clearing confusion on tenure stations for Account wing, it has been finally decided to keep tenure stations for account wing executives also same as that of Telecom wing and it has been implemented by issuing first such order from tenure transfers. But till today, no formal letter is issued for change of tenure station for account wing executives. GM HR Admn Mumbai assured to look into it and get such order issued.

8.     Fresh Orders for DGM LA as extension also expired: We have brought to the notice of GM HR Admn Mumbai that the period of DGM LA Orders has been expired long back and it is continued by issuing extension orders. Also extension orders issued are without any break in Looking after arrangements.  We also drawn his attention towards fact that though extension order has been issued for Telecom wing no such extension order has been issued for Account wing and some officers at their own have issued orders for extension of DGM LA but no any letter is issued for all DGM LA in finance wing. Further there are much changes in scenario when the earlier DGM LA was issued and some names excluded in last spell for no mistake on part of individuals needs to be added in the list of DGM LA and some names needs to exclude from DGM LA. GM HR Admn Mumbai informed that file for extension of DGM LA is already processed and assured to issue the fresh DGM LA for Telecom as well as Account wing as early as possible.

9.     Review of SSA wise Justification of executives in Civil and Electrical wing: We have requested to GM HR Admn Mumbai for review of SSA wise executives strength for Electrical and Civil wings as per uniform policy applicable to all SSAs/BAs and at least give justified post equally for all SSAs/BAs in same category. At present the justification of post is not done uniformly and hence some executives are unnecessarily being disturbed on name of excess shortage. GM HR informed that he has to understand issues and then he can decide on it and requested us to give him time to understand issues.

10.            Consideration of Request of Electrical wing executives declared as excess sand deputed to SSAs: W have brought to notice of GM HR Admn Mumbai the difficulties faced by these executive by untimely orders for Telecom wing when they are eligible for long stay transfers. WE have added that we have discussed this issue with CE Elect Mumbai and he has directed to take up matter with GM HR as their request is to be given consideration by his office only and electrical wing has sent e-file for same. GM HR Admn Mumbai informed that he also has seen this e file, but same seem to be sent back to Electrical wing. He assured to give consideration to request of these JTOs in Electrical wing depurated to Telecom wing.

11.             Issues in Consideration of Account wing request for change of SSA/Retention: We have drawn attention of GM HR Admn Mumbai for review of the transfer orders of Account wing executives issued earlier, which is pending for long time. We also have shared copy of letter given by SNEA MH on the subject and narrated in brief issues created due to such pick and choose transfers. GM HR assured that he is not aware about these issues and will take up updates from concerned officers and will take suitable action to review all these case. 

12.            Dispute between the Finance wing and HR wing on handing over files of Account wing: We have drawn attention of GM HR Mumbai about issues created due to prolonged dispute between DGM Legal and DGM Fin Mumbai about the handing over the files of FC section and how it has delayed the works of confirmation of JAOs who have completed two years’ probation period and how the request of JAOs are not settled even after they have left BSNL and joined other organizations. WE have categorically brought to his notice about request of JAO who has lefts BSNL before two years, but till his formal relieving order is not issued and file is pending in old FC section office. He re DGM Fin Mumbai says that files are handed over to DGM legal and DGM legal says that files are not handed over and only letter is given DGM Fin Mumbai. We have further added that we have discussed this issue with DGM Legal Mumbai and he was of the opinion that the Account section and DGM Fin is not cooperating him as neither files have been handed over to him nor the suitable JAO/AO is transferred for taking care of these works. DGM legal has stated that matter is well known to GM HR, GM Fin Mumbai and even CGMT MH and firmly said that now CGMT MH has to take action on it. When requested to discuss this issue with DGM Fin Mumbai and get it settled, DGM legal has informed that he has already discussed it with GM Fin Mumbai but there is no response and now he will not discuss it with DGM Fin Mumbai and let CGMT MH take action on it. We further informed GM HR that we have discussed this issue with DGM Fin Mumbai and it has assured that the files are transferred along with transfer of then JAO FC Mumbai Shri Raju Pathak and he has already joined under GM HR Admn Mumbai along with all files and records of FC section.  DGM Fin Mumbai further informed that one more JAO Mrs. Nisha Chaudhary has been transferred to GM HR Admn Mumbai and hence there is no need to post further AOs/JAOs in staff section. We have made it clear to GM HR Admn Mumbai that this dispute is pending for last one and half year i.e. since VRS 2019 and there is immediate need to settle this issue by resolving prolonged dispute between DGM Legal and DGM Fin Mumbai. In conclusion GM HR Admn Mumbai has assured to look into dispute and see that HR works of account wing are also taken care properly and also assured to look into pending orders for confirmation of JAOs.

13.            Issues related to fake cast compliant and review thereof: We have detail discussions on manmade issues created by certain officers in joining hands with certain complainant and harassment of executives and non-executives working in BSNL.  We have narrated incident how executives in ST Category is mass are named as fake cast and how atrocities have been created over the year. The certain officers are playing with life and sentiments of the executives in ST Category. Many executives under compliant have submitted valid cate certificate, but till time they have been defamed as employee with Fake caste. We also narrated how executives who have applied for VRS or retired from services are being deprived even from Provisional pension by officers dealing with case by wrongly interpreting orders from BSNL CO. GM HR Admn Mumbai informed that he is aware about the case and his office has just conveyed to CCA for releasing provisional pension to all such employees/executives and very shortly it will be paid. He added that there are certain issues to be taken care by BSNL CO and he will see that all the guideline sand orders issued by BSNL CO will be followed in Maharashtra Circle. He directed us to take up issues with BSNL Corporate Office and assured to extend all possible co-operation from his office as per direction of CGMT MH Circle.

14.            Rearrangements of DGMs in Circle Office Mumbai: We have brought to notice of GM HR Admn Mumbai about unequal distribution of DGMs in Circle Office Mumbai and his office has more DGMs but other offices do not have DGMs for long time. We have also narrated him that CGMT MH has instructed to issue orders for additional DGM LA for filling vacant post in EB, Mobile, and Transmission section and since last 3-4 months the files is not initiated and direct instructions of CGMT MH are ignored. We elaborated wrong practices started by giving HR works to DGM legal and by giving Admn works to DGM HR when ne separate DGM Admn is also posted. Such posting is creating confusion among executives and offices and it is underutilization of available manpower. There is need of either correcting designations or rearrangements of works, but HR activities should be with DGM HR and not with DGM legal as mismanaged now. GM HR gave patience hearing to our say and assured to have review of working of DGMs in Circle office Mumbai very shortly and have proper distribution along with filling of vacant posts in different sections either by rearrangements or by addition LA orders.   

15.            Decision of Distribution of Certificate of VRS Opted Executives: We have again drawn attention of GM HR Admn Mumbai about undue delay in distribution of Certificates of VRS Optees from Circle Office Mumbai. GM HR Admn Mumbai immediately instructed DGM Admn Mumbai to instruct AD Admn Mumbai to handover the certificates to all the VRS Optees who are visiting or will be visiting for medical related issues and further directed to send remaining certificates to the residential address of concerned VRS Optees and see that all the certificates are distributed in time bound manner of two months. 

16.            Stopping deduction on Medical reimbursement on discount: We have reminded GM HR Admn Mumbai about our discussions in the last meeting on the said subject and till no action has been taken on it. GM HR Admn Mumbai informed that he did not get time for same, but assured to review it and decide on it at the earliest. 

17.            Review of higher rates approved for canteen beyond tender period: This issue also was again brought to the notice of GMHR Admn with consequences of tendering procedure and issues thereof. GM HR Admn Mumbai directed DGM Admn Mumbai to look into issues and see that fresh tenders are called by CPC section.

In conclusion, we requested to GM HR Admn Mumbai to look into issues and settle all these issues with priority to the issues related to publication of SSA wise executive strength, Long stay list of executives, list of Request/options received by staff section as it is time bound process and there is already delay in reviewing transfer orders kept in abeyance. In conclusion GM HR Admn Mumbai assured to take care of all these issues one by one and meeting concluded with thanks form both the sides. 

 

 8 JUL 21: DGM Legal Mumbai endorsed the JTO to SDE Promotion orders and all the promoted executives are posted as where it is as it is basis.   Letter <<<>>>

·        DS SNEA concerned are requested to take up matter with SSA/BA Administration for endorsing these orders where it is as it is basis at par with decision of BSNL Corporate Office. Rearrangements among executives required if any can be done later and there should not be any delay in joining of these promoted officers on name of rearrangements.

7 JUL 21: Jt GM Pers SM BSNL CO issued orders for opening of Window of Online Transfer Portal from 16/07/2021 to 31/07/2021 for submitting inter Circle request transfers by SDEs/AOs  and above cadres.   Letter <<<>>> 

·        This Online Transfer Portal (OTP) has been introduced in this financial year and requests for any inter Circle transfer orders in SDE/AO and above cadre are to be submitted by online through self ESS Login.

·        Though , the orders for First Quarters are not yet issued even though the time schedule given for it over, this window of OTP is being opened from 16th July 2021 and it has been clearly mentioned in this letter that who has applied earlier need not to apply again for same transfer. 

·        By taking experience in past, there are certain modifications done in this revised procedure and now no SSA/BA Head can keep on hold the request of any Officer and if no action is taken by SSA/BA Head or Circle GM HR, the applications pending in their Login ID will be automatically be received by PGM Pers BSNL CO and it will be given consideration.

·        Further, in case of BAs having more than one GM/PGM, tone of them will be nominated for recommending the OTP request transfers.

·        GM HR concerned has to put remarks viz. completion of tenure period at all India Hard Tenure period or the position of executive in the longest stay list of Circle and stay period in Circle on post/Station/Circle.  

·       It is expected that the transfer orders of the executives who have applied under OTP in last Quarters will be issued in this week itself.

 

7 JUL 21: Jt GM Pers SM BSNL CO issued timelines for all executives in submission of self-Appraisal of e-APR 2020-21 latest by 15/07/2021 with warning that non-submission of Self-Appraisal in given time will be viewed seriously and further action will be taken as per extent rules.   Letter <<<>>>   

SNEA MH appeals all the executives to follow the instructions and submit the self-Appraisal of e-APR 2020-21 well within this extended time and avoid last minute rush or office complications thereof.   

 

 7 JUL 21: DGM Admin BSNL CO issued orders for provision of concessional FTTH connections to serving/retired BSNL executives as well as Non-Executives and it is applicable only in BSNL Area.  Letter <<<>>>

·        This was long pending demand raised by SNEA, same is given consideration by Management Committee of BSNL subject to 40% concession on Plan Charges with celling of Rs. 300 per month in BSL Area.

·        In MTNL area, the existing guidelines for providing concessional Broadband will continue.

·        This concession is available only to plan charges and the concerned employees/executives will have to bear the cost or rent of Modem, installation Charges, activation charges as applicable in case of provision of FTTH Connection to ordinary subscribers.

·        The FTTH Connection, working under private capacity and or 10% concessional scheme will be allowed to be migrated to this plan.

·        This concessional FTTH Connection will be provided in lieu of the existing concessional Broadband, FSRTC or concessional FTTH Connection under 10% discount.

·        The last date for submission of options directly by email on adstaffbmhco@gmail.com adstaffamhco@gmail.com or agsmstaffmh2018@ gamil.com is 09/07/2021.  

·        In second phase of review of Transfer orders kept in Abeyance, the review of transfers from and to Non Tenure Stations is being done as per concern raised by SNEA MH by pointing out the issues in publishing data in transparent manner and CGMT MH and GM HR Has assured to publish data showing the actual working strength and executives in long stay in Particular SSA.

·        But it is seen that data is republished in same format continuing with the attempt of hiding the important figures of working Executives and list of executives who are at the top of SSAs having excess Executives strength.

·        It is difficult for one to access for individuals, where he/she is in the long stay list of executives or not and who has to opt for transfers at these stations and just showing “In/Out” numbers will not solve the purpose of calling Options for filling vacant posts. 

·        Only changes made seems to be done in this revised letter is that the number of executives who are relieved as per earlier transfer order before it was kept in abeyance and there is reduction in number of vacant post in SSAs having shortage of executives as compared to earlier figures which will reduce the number of transfers to be effected for filling vacant posts.  

·        Till there is confusion as in telecom wing for “Transferred In” the Executives in JE/JTO/SDE Cadre are shown as 69 whereas transferred out is shown as 71 which should have been equal as it is aimed at filling out only vacant posts.

·        For account wing this figure tallies as total 40 JAOs/AOs are shown as “Transferred In” and “40 JAOs/AOs are shown as Transferred out”.

·        In DE/AGM Cadre, till the officers in Staff section seems to be under confusion as Excess DEs/AGMs are shown as Four only and Transferred in are shown as 11 and difference is shown as Seven wherein executives will be posted from SSAs already having shortage of AGMs/DEs, which is against the guidelines issued by BSNL CO to meet shortages in DE/AGM cadre under local Looking After arrangements.

·        It is difficult to understand how vacant posts can be filled by creating another vacancies at other SSAs/BAs, but there are certain assumptions on part of these officers, and hence such proposals are moved in file.     

·        Before publishing data, we have drawn attention of DGM Legal Mumbai on this issue quoting assurance given by CGMT MH to publish data in Transparent manner showing Justified post, working Executives and then Excess/Shortage and but DGM Legal Mumbai informed that he has not received any instructions from CGMT MH and hence he is following the old method without any changes. When asked, what use of republishing data is, he replied to take up matter with CGMT MH Circle.

·        SNEA MH will discuss these issues with GM HR Admn Mumbai and CGMT MH and will pursue for getting data published with working strength and long stay list of executives from SSAs having excess executives as per this data.

·        Meantime, SNEA MH has received many call from the members as these letters have created much confusion and fresh doubts/fears among the executives as new sentence is added and nothing is taken care as assured by CGMT MH for transparent working.

·        The sentence added in letter that No request shall be considered from Shortage to surplus BA/SSA has created more confusion and unrest among executives who have requested for transfer and whose request has been given consideration in last order which has been kept in abeyance. It is feared by these executives that their request from SSA having shortage executives to Excess executives will not be given consideration. We have seen that someone is deliberately trying to create confusion among the members and no one should get confused as CGMT MH has assured to given consideration to request transfers of all executives from Non tenure stations who have completed three years stay at present SSA as on 30/06/2021.  

·        It is to inform that these are letters calling for willingness /options for filling vacant posts in SSAs having shortage of executives and not filling vacant post in SSA/BAs having excess Executives.

·        As such, there was no need of addition of this sentence as that No request shall be considered from Shortage to surplus BA/SSA because no such transfers are under consideration in this phase of review. But as seen in past, some extra ordinary officers in Staff section are playing with the sentiments of the executives just to create confusions and fear in minds of executives or may be due to lack of knowledge/information  about discussions and instructions given by CGMT MH in the meeting held with SNEA and online Meeting with all three Associations.

·        Please note that these are options/willingness called for filling vacant post in SSAs having shortage of executives and hence only options are to be given if anyone is the Top of long stay list of SSAs having shortage of executives and due for transfer to SSAs having shortage of executives.

·        For example, in Nagpur SSA Nine executives of Telecom wing are shown as transferred out from Nagpur SSA, then then Top Nine executives in cadre of JE, JTO and SDE with combined long stay list will be due for transfer out of Nagpur SSA and only such nine executives will have to opt for any of the SSA where shortage of executives is shown i.e.  Ahmednagar, Beed, Akola, Yavatmal, Buldhana, Jalna, Dhule, Kolhapur, Nanded, Parbhani, Satara, Solapur, Osmanabad and CO Mumbai wherein “Transfer In” figures are shown. 

·        Thus these Nine long stayed JE/JTO/SDE in Nagpur SSA will have to opt for any of SSA or be ready for posting in any of these SSAs and their transfer order will be issued in the Company cost with preference to the Own cost Transfers means if anyone opts at own cost, he will be given priority over another opting at company cost and maximum consideration of options for any particular SSA will be to extent of vacancies shown.   

·        As such, one working at SSA/BAs having excess executives has to ascertain his/her position at the combined long stay list of their SSA in Telecom wing JE/JTO/SDE and in Account wing JAO/AO, number of Executives excess in their SSA and decide to opt for any suitable place among these SSAs or be ready for posting at any of these SSAs at company cost.

·        The executives in SSAs/BAs not having excess executives as on today, may have analysis of the “Incoming Requests” to their SSA/BA and ascertain the possibility of their transfers during consideration of request transfers on one to one basis and be ready for posting in BA/SSAs from where incoming requests are pending to their SSA. If he /she is not willing to join as substitute to any of these SSAs, then he/she should review, think and opt for any of the SSA/BA wherein vacancies are shown as of now as at later stage it may not be possible even though it may be nearby SSA /BA.

·        The executives who are already under transfer at Odd Place/locations and do not want to join that place and may opt fresh for any of these SSAs/BAs of his his/her choice wherein vacancies are shown now.

·        This is right time to have critical analysis of the position of self in SSA combined long stay list of JE/JTO/SDE , JAO/AO and DEs/AGMs,  Excess/Shortage of executives in SSAs/BAs and incoming request to their working SSA and wisely opt for any of the choice SSA/BA.

·        It is seen that many of the executives do not opt for any of station assuming that one more is ahead of him and her and such small gap can be crossed at any time due to change in circumstances and hence one has to take advance action to avoid last minute issues and difficulties.  

·        Further, the executives who have opted for not joining tenure station second time and working in SSAs having excess strength are requested to opt for any of the SSA/BA as called in these letters as they are in long stay list of SSAs and their names are under consideration for posting in any of these SSAs/BAs.  

·        It is fact that the time taken by officers in staff section to review the orders and data is more, but to take care of issues created due to pick and choose transfers earlier, it is taking time more than the fresh works, but SNEA MH is continuously pursuing for early restoration of orders by resolving issues created and to reduce difficulties faced by the executives due to pick and choose transfers.

·        The executives not in SSA long stay list need not to be panic even if they have applied for request transfer earlier and his/her order is kept in abeyance, as same will be released after filling these vacant posts most probably in period of fortnight

·        Though remaining issues will be discussed and will be taken care with confirmation from GM HR Admn Mumbai, SNEA MH appeals all executives in general and executives in SSA long stay in particular to have critical analysis of the data of excess/shortage of executives and their position in the long stay list of their SSAs and submit options accordingly or be ready for transfers at any of these BA/SSAs at company cost.
